  1. All goods, live-stock, or merchandise landed at any of the before-mentioned wharves shall be so landed at the shipper's own risk, and the master, owner, or agent of the vessel landing the goods, live-stock, or merchandise shall be responsible for the delivery to the consignee.

  2. Any goods, live-stock, or merchandise placed on any of the said wharves for shipment shall be placed there at the consignor's own risk, and the consignor shall be solely responsible for the safety of the said goods until accepted by the master, owner, or agent of the vessel.

  3. Although the Council has erected the wharves for the convenience of shippers and charges for the use of those conveniences, no claim shall be sustainable against the Council for the loss of any goods, live-stock, or merchandise passing through the wharf sheds, but nothing contained in this condition shall be deemed to relieve the Council from liability for negligence on the part of any servant of the Council.

PENALTIES.

Any person, firm, or company refusing to carry out the instructions of the wharfinger or other duly accredited person necessary for the good management of any of the wharves mentioned in this Order in Council, or permitting the remains of fish offal or other offensive matter to be placed in or about any wharf premises, or using the said wharf premises for any purpose for which such premises was not intended, or doing anything herein forbidden, commits a breach of this Order in Council, and shall be liable to a fine not exceeding £20.

ORDER IN COUNCIL.

At the Government House at Wellington, this 23rd day of December, 1942.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS in pursuance of section one hundred and thirty-six of the Municipal Corporations Act, 1933, a petition was presented to the Governor-General praying that a certain area of land be excluded from the County of Waimairi and included in the City of Christchurch :

And whereas it is deemed expedient to make such alteration of the boundaries of the said city :

Now, therefore, in pursuance and exercise of the powers and authorities vested in him by the said Municipal Corporations Act, 1933, and of all other powers and authorities enabling him in that behalf, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby declare that as on and from the first day of April, one thousand nine hundred and forty-three, the area described in the Schedule hereto shall be excluded from the County of Waimairi and included in the City of Christchurch.

SCHEDULE.
AREA EXCLUDED FROM THE COUNTY OF WAIMAIRI AND INCLUDED IN THE CITY OF CHRISTCHURCH.

ALL that area of land in the Canterbury Land District, being part of the Avon Riding of the Waimairi County, and bounded by a line commencing at a point on the boundary of the City of Christchurch, being the intersection of the centre-line of Banks Avenue and the production westward of the northern side of Cooper’s Road ; proceeding thence easterly to and along the north side of Cooper’s Road to the eastern boundary of Section 45, S.O. plan 7026 ; thence northerly along the eastern boundaries of Sections 45 and 19, S.O. plan 7026, across Achilles Street, to and along the eastern boundary of Section 18, S.O. plan 7048, to the north-eastern corner of said Section 18 ; thence westerly along the northern boundaries of Sections 18, 17, 15, S.O. plan 7048, across Bampton Street, to and along the northern boundaries of Sections 13, G, 12, 11, 10, 9, 8, 7, and 6 on the said plan, to the south-eastern corner of Section 46, S.O. plan 7140 ; thence northerly along the eastern boundaries of Sections 46, 47, 48, and 49, S.O. plan 7140, to the south-eastern corner of Lot 2, D.P. 12120 ; thence northerly, westerly, and northerly along the eastern, northern, and eastern boundaries of the said Lot 2, D.P. 12120, to the southern side of New Brighton Road ; thence westerly along the southern side of New Brighton Road and its production westward to the centre of North Parade (being a point on the boundary of the City of Christchurch) ; thence southerly and south-easterly along the said boundary of the City of Christchurch to the commencing point.

IN pursuance and exercise of the powers and authorities conferred on him by section twenty-five of the Naval Defence Act, 1913, and of all other powers and authorities enabling him in that behalf, His Excellency the Governor-General, with the advice of the Executive Council, doth hereby amend and supplement the regulations referred to in the Schedule hereto as shown therein.
