Declaring certain Crown Land to be subject to Part I of the Native Land Amendment Act, 1936 (Ngataki Development Scheme).

A PROCLAMATION.

PURSUANT to section five of the Native Purposes Act, 1939, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, do hereby declare the Crown land described in the Schedule hereto to be subject to Part I of the Native Land Amendment Act, 1936, and to be included in the Ngataki Development Scheme.

ALL that area of land in the Tokerau Native Land Court District containing by admeasurement 213 acres 3 roods 20 perches, more or less, being more particularly described as follows:—

Consenting to the Raising of a Loan of £13,000 by the Otago Central Electric-power Board and prescribing the Conditions thereof.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 14th day of January, 1942.

Present:

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL.

WHEREAS the Otago Central Electric-power Board (hereinafter called “the said local authority”) being desirous of raising the sum of thirteen thousand pounds (£13,000) by a loan to be known as “Electrical Generation Loan, No. 2, 1941” (hereinafter called “the said loan”), for the purpose of constructing additional headworks and a further generating station at the Roaring Meg Stream and access thereto, has complied with the provisions of the Local Government Loans Board Act, 1926 (hereinafter called “the said Act”), and it is expedient that the precedent consent of the Governor-General in Council, as required by the said Act, should be given to the raising of the said loan :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the said Act, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby consent to the raising in New Zealand by the said local authority of the said loan for the said purpose up to the amount of thirteen thousand pounds (£13,000), and in giving such consent doth hereby determine as follows:—

(1) The term for which the said loan or any part thereof may be raised shall not exceed ten (10) years.

(2) The rate of interest that may be paid in respect of the said loan or any part thereof shall be such as shall not produce to the lender or lenders a rate or rates exceeding three pounds fifteen shillings (£3 15s.) per centum per annum.

(3) The said loan or any part thereof, together with interest thereon, shall be repaid by equal aggregate annual or half-yearly instalments extending over the term as determined in (1) above.

(4) The payment of such instalments shall be made in New Zealand, and no instalments shall be paid out of loan-moneys.

(5) The rate payable for brokerage, underwriting, and procurement fees in respect of the raising of the said loan or any part thereof shall not in the aggregate exceed one-half per centum of any amount raised.

(6) No moneys shall be borrowed under this consent after the expiration of two years from the date hereof.

Vesting the Management of the Le Bon’s Bay Wharf in the Akaroa County Council.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 7th day of January, 1942.

Present:

THE HON. W. NASH PRESIDING IN COUNCIL.

PURSUANT to the Harbours Act, 1923, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council, doth hereby vest in the Akaroa County Council (hereinafter called “the Council,” which term shall include its successors or assigns unless the context requires a different construction), the management of the wharf at Le Bon’s Bay, as shown on approved plan marked M.D. 2344 and deposited in the office of the Marine Department at Wellington, such vesting to be subject to the terms and conditions set forth in the First Schedule hereto, and doth hereby prescribe that the dues and rates set forth in the Second Schedule hereto shall be charged and taken by the Council for the use of the said wharf.

FIRST SCHEDULE.

CONDITIONS OF MANAGEMENT.

  1. THE vesting of the said wharf is subject to the Foreshore License Regulations 1940, and the provisions of those regulations shall, so far as applicable, apply hereto.

  2. The term of the vesting shall be fourteen years from the 6th day of December, 1941.

  3. The master of every vessel discharging ballast at the said wharf shall have all such ballast taken away and deposited above high-water mark, or at such place as may be approved by the Minister or by any person appointed by the Minister for that purpose.
