DEC. 10.]\nTHE NEW ZEALAND GAZETTE.\n2875\nAuthorizing the Laying-off of a Road of less Width than 66 ft.\nWHEREAS in the opinion of the Minister of Lands it is\ninexpedient, by reason of the fact that the land shown upon\nthe plan of Town of Takapuna Extension No. 149 (No. 2951),\naffecting part of Allotment 190, Takapuna Parish, Block VIII,\nWaitemata Survey District, North Auckland Land District, is\nintended to be used wholly for residential purposes, that part of\nMidway Avenue, adjoining Lots 19 to 33 inclusive, shown thereon\nshould be of the width of 66 ft.:\nNow, therefore, in pursuance of the power conferred upon him\nby section 17, subsection (1), of the Land Act, 1924, and of every\nother power him thereunto enabling, the Minister of Lands doth\nhereby authorize the laying-off of part of Midway Avenue, adjoining\nLots 19 to 33 inclusive, of a width of not less than 50 ft.:\nProvided always that it shall not be lawful for any person to\nerect or cause to be erected any building at a less distance than 33 ft.\nfrom the middle of such road.\nGiven under the hand of the Minister of Lands, this 4th day of\nDecember, 1942.\nJ. This Order may be cited as the Shipping Safety (Queen\nCharlotte Sound) Order 1942.\n2. This Order shall take effect on the day following the date\nof publication thereof in the Gazette.\n3. This Order shall apply with respect to all small craft, as\ndefined in the Shipping Safety Emergency Regulations 1940†, to\nwhich the Shipping Control Emergency Regulations 1939‡ do not\napply.\n4. No master or person in charge of any small craft to which\nthis Order applies shall cause or permit the vessel to be anchored\nin any part of the waters described in the Schedule hereto.\nSCHEDULE.\nPROHIBITED ANCHORAGE.\nTHE waters in Queen Charlotte Sound within the following limits :\nFrom Kempe Point (latitude 41° 2’ 14” S., longitude 174° 19’ 00” E.)\nby a line in a 150° direction to the point of its intersection with the\nopposite shore; thence along the shore to Clarke Point; thence\nby a straight line to the north-eastern point of Pickersgill Island ;\nthence along the northern and western shores of Pickersgill Island\nto the south-western point of that island; thence by a line due\nwest to Blumine or Pig Island; thence around the northern shore\nof that island to a point from which a line is drawn in a 297° direction\nto Edgecumbe Point; thence by a straight line to Scott Point;\nthence along the shore to Kempe Point.\nDated at Wellington, this 3rd day of December, 1942.\nF. This Order may be cited as the Shipping Safety (Hauraki\nGulf and Auckland Harbour) Order 1942.\n2. This Order is in substitution for the Shipping Safety (Hauraki\nGulf) Order 1942†, and that Order is hereby consequentially revoked.\n4. Except where otherwise specially provided, this Order shall\napply with respect to all small craft, as defined in the Shipping\nSafety Emergency Regulations 1940†, to which the Shipping Control\nEmergency Regulations 1939§ do not apply.\n5. No master or person in charge of any small craft to which\nthis Order applies shall cause or permit the vessel to be in any\npart of the waters described in the First Schedule hereto.\n6. No master or person in charge of any small craft to which\nthis Order applies shall cause or permit the vessel to be anchored\nin any part of the waters described in the Second Schedule hereto.\n7. Except in accordance with the terms and conditions of a\nwritten permit granted by the Naval Officer in Charge at Auckland,\nno master or person in charge of any small craft to which this\nOrder applies shall cause or permit the vessel to enter or move in\nany part of the waters described in the Third Schedule hereto :\nProvided that nothing in this clause shall apply with respect to—\n(a) Vessels engaged on Government or Harbour Board service :\n(b) Trading vessels :\n(c) Vessels being used during a period of emergency, within the\nmeaning of the Emergency Reserve Corps Regulations\n1941||, for the purposes of any emergency precautions\nservice within the meaning of those regulations.\n8. The provisions of this Order are in addition to and not in\nderogation of the provisions of the Public Traffic Regulations 1939\nfor the Port of Auckland.\nFIRST SCHEDULE.\nPROHIBITED PASSAGE.\nTHE waters of the Hauraki Gulf within the following limits :\nFrom Bollon’s Rock (on the western side of Tiritiri Island) in a\n175° direction to Gardiner’s Gap between Rangitoto Island and\nMotutapu; thence along the northern shore of Motutapu to Home\nBay Point on the eastern side of Motutapu; thence along the\nlimit of the Auckland Harbour to Waiheke Island ; thence along the\nnorthern shore of Waiheke Island to Thumb Point; thence in a\n326° direction for a distance of approximately fourteen miles to a\nposition in latitude 36° 33’ S., longitude 175° 01’ E.; thence in a\n270° direction to longitude 174° 55’ E.; thence in a 220° direction\nto Bollon’s Rock, the commencing point.\nSECOND SCHEDULE.\nPROHIBITED ANCHORAGE.\nTHE waters of Hauraki Gulf within the following limits : From\nRakauananga Point on the southern side of Whangaparaoa Peninsula,\nby a line in a 120° direction for a distance of approximately five\nmiles to the point of its intersection with a line in a 175° direction\nfrom Bollon’s Rock (on the western side of Tiritiri Island); thence\nin a 355° direction to Bollon’s Rock; thence in a 040° direction to\nlongitude 174° 55’ E.; thence in a 090° direction to a position in\nlatitude 36° 33’ S., longitude 175° 01’ E.; thence in a 326° direction\nto Flat Rock; thence in a 310° direction to Kawau Island; thence\nalong the southern shore of Kawau Island to the southern entrance\nof Bon Accord Harbour; thence by a straight line to Fish Point\n(latitude 36° 26’ 2” S., longitude 174° 47’ E.); thence along the\ncoast of the mainland to Rakauananga Point, the commencing point :\nexcluding, however, the waters of Mahurangi Harbour, Waiwera\nCreek, and all other rivers, creeks, or streams entering the Gulf\nbetween Fish Point and Whangaparaoa Peninsula.\nTHIRD SCHEDULE.\nRESTRICTED PASSAGE.\nFROM East Tamaki Head (latitude 36° 50’ 7” S., longitude 174° 54’ E.)\nin a 064° direction to Park Point on Waiheke Island ; thence along\nthe shore of Waiheke Island to the western entrance point of\nOwhanaki Bay; thence along the limit of the Auckland Harbour\nto Home Bay Point on the eastern shore of Motutapu; thence\nalong the northern shore of Motutapu to Gardiner’s Gap between\nMotutapu and Rangitoto Island ; thence in a 355° direction to\nBollon’s Rock (on the western side of Tiritiri Island); thence in a\n040° direction to longitude 174° 55’ E.; thence in a 090° direction\nto a position in latitude 30° 33’ S., longitude 175° 01’ E.; thence\nin a 146° direction to Thumb Point on Waiheke Island; thence in\na 000° direction to latitude 36° 30’ S.; thence in a 285° direction to\nFlat Rock; thence in a 310° direction to Kawau Island; thence\nalong the southern shore of Kawau Island to the southern entrance\npoint of Bon Accord Harbour; thence by a straight line to Fish\nPoint (latitude 36° 26’ 2” S., longitude 174° 47’ E.); thence along\nthe coast of the mainland and the shores of the Auckland Harbour\nto East Tamaki Head, the commencing point : including, however,\nthe waters of Mahurangi Harbour, Waiwera Creek, Weiti River,\nand all other rivers, creeks, or streams entering the Gulf or the\nAuckland Harbour between Fish Point and East Tamaki Head.\nDated at Wellington, this 4th day of December, 1942.\nF.
