NOTICE is hereby given in pursuance of the Regulations Act, 1936, of the making of regulations and orders as under:—

Revoking Part of a Proclamation defining the Middle-lines of Portions of a Road in Blocks II, III, and VIII, Paekakariki Survey District—viz., Portions of the Plimmerton–Paekakariki Road.

A PROCLAMATION.

IN pursuance and exercise of the powers and authorities vested in me by the Public Works Act, 1928, and of every other power and authority in anywise enabling me in this behalf, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, do hereby revoke the Proclamation dated the twelfth day of July, one thousand nine hundred and thirty-eight, and published in the New Zealand Gazette No. 52 of the fourteenth day of the same month at page 1640, and deposited in the Land Registry Office at Wellington as No. 2709, defining the middle-lines of portions of a road in Blocks II, III, and VIII, Paekakariki Survey District—viz., portions of the Plimmerton–Paekakariki Road—in so far as it affects Lot 46, D.P. 729, Township of Plimmerton, comprised and described in Certificate of Title, Volume 172, folio 61, Wellington Registry.

Given under the hand of His Excellency the Governor-General of the Dominion of New Zealand, and issued under the Seal of that Dominion, this 3rd day of November, 1942.

Portion of Edgeware Road, in the City of Christchurch, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 4th day of November 1942.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Christchurch City Council on the seventh day of September, one thousand nine hundred and forty-two, viz.:—

“The Christchurch City Council, being the local authority having control of the streets in the City of Christchurch, hereby, by resolution, declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the northern side of portion of Edgeware Road adjoining the land comprised in Certificate of Title 254/203, being part R.S. 219 and part Lot 57, D.P. 2004, other part of the said R.S. 219 ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the northern side of the portion of Edgeware Road (described in the Schedule hereto) within a distance of sixty-six feet from the southern side of the said portion of street.
