Authorizing the Otago Central Electric-power Board to use Water from Wye Creek for the Purpose of Generating Electricity, and to construct, maintain, and use Electric Works, and revoking a certain existing Order in Council.

ORDER IN COUNCIL.
At the Government House at Wellington, this 22nd day of October, 1941.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

PURSUANT to the Public Works Act, 1928, and the Electric-power Boards Act, 1925, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth, subject to the terms and conditions set forth in the First Schedule hereto, hereby grant to the Otago Central Electric-power Board (hereinafter referred to as “the licensee”) a license to obstruct, impound, and divert the waters of Wye Creek (hereinafter referred to as “the said stream”), in Block V, Coneburn Survey District, in the Otago Land District, and to take and use therefrom for the purpose hereinafter set forth, a stream of water not exceeding eight cubic feet per second at any one time, and further doth, subject to the said terms and conditions in the First Schedule hereto, authorize the licensee to lay, construct, put up, place, and use the electric lines described in the Second Schedule hereto; and, further, for the purposes of section seventy-six of the Electric-power Boards Act, 1925, doth hereby authorize the licensee to construct, maintain, and use the said electrical works; and, further, with the consent of the licensee, doth hereby revoke the Order in Council described in the Third Schedule hereto as from the day on which this Order in Council becomes effective.

FIRST SCHEDULE.

  1. IMPLIED CONDITIONS.

THE conditions directed to be implied in all licenses by the Electrical Supply Regulations 1935, and the Electrical Wiring Regulations 1935, and by Regulation 6 of the Water-power Regulations 1934, shall be incorporated in and shall form part of this license except in so far as the same may be inconsistent with the provisions hereof.

  1. LICENSE SUBJECT TO REGULATIONS.

This license is issued under the Water-power Regulations 1934, and the Electrical Supply Regulations 1935, and the Electrical Wiring Regulations 1935, and is subject thereto and to any regulations made or to be made in amplification or amendment thereof or in substitution therefor: Provided that the licensee shall not by virtue of this clause be required except in the normal course of alterations, repair or maintenance, to reconstruct in conformity with the regulations hereinbefore mentioned any existing electric lines or works which conformed to the regulations in force at the time of the construction thereof.

  1. UTILIZATION OF WATER AND LOCATION OF HEADWORKS.

Water shall be used under this license solely for the purpose of generating electricity, and shall be taken from the said stream at the headworks as indicated on the plans marked P.W.D. 109542 and 110215, deposited in the office of the Minister of Public Works at Wellington.

  1. GENERAL DESCRIPTION OF WORKS.

The licensee is hereby authorized, subject to the conditions herein contained, to maintain and use the following works for the purposes of this license, the position and details of the said works being indicated on the said plans P.W.D. 109542 and 110215:—

(a) Headworks consisting of weir and necessary intake on the northern arm of Wye Creek in Run 331, Block V, Coneburn Survey District.

(b) Pipe-line leading from the intake to the power-house, situated in the said Run 331 near the point where Wye Creek crosses the Kingston—Queenstown Main Highway, giving a static head of approximately 1,035 ft.

(c) Tail-race from the power-house to the said stream.

(d) Power-house with all necessary equipment for generating electricity.

(e) The electric lines described in the Second Schedule hereto.

  1. SYSTEM OF SUPPLY.

The system of supply shall be as described in paragraphs (a) and (f) of clause 21—01 of the Electrical Supply Regulations 1935.

The generating voltage shall be 400 volts between terminals and shall be transformed up to 33,000 volts between phases for transmission purposes. The primary distribution voltage shall be approximately 11,000 volts between phases and the secondary distribution voltage 400 volts between phases and 230 volts between any phase and neutral.

  1. CHARGES FOR ELECTRICAL ENERGY.

The charges for electrical energy shall not exceed 1s. per unit for lighting purposes and 6d. per unit for motor-power, heating, or cooking purposes: Provided that “lighting purposes” shall include the operation of motor generators for lighting purposes; and, provided further, that if accounts are paid within fourteen days of due date the charges shall not exceed 10d. per unit for lighting purposes and 5d. per unit for motor-power, cooking, and heating purposes.

In the case of wholesale supply the charge shall not exceed £16 per kilovolt-ampere per year plus ½d. per unit. “Wholesale supply” for this purpose shall be held to be a supply in respect of which the consumer shall guarantee to pay not less than £180 per year.

  1. TIME FOR COMPLETION OF WORKS.

The period for completion of the works authorized in Part A of the Second Schedule shall be three years from the date of this license.

  1. DURATION OF LICENSE.

This license shall, unless sooner determined, continue in force until the 14th day of December, 1964.

  1. DAY ON WHICH ORDER TO TAKE EFFECT.

This license is collateral with an Order in Council authorizing the purchase of certain electrical works by the licensee from the Goldfields Dredging Company, Limited (in liquidation), in pursuance of an agreement dated the 3rd day of April, 1941, between the Goldfields Dredging Company, Limited (in liquidation), of the one part, and the licensee of the other part (of which agreement a copy is deposited in the office of the Minister of Public Works), and shall take effect on the day when the electrical works vest in the licensee in pursuance of that agreement.

  1. RENTAL.

For the purpose of assessing the rental or annual sum payable in respect of this license in accordance with the Water-power Regulations 1934, the licensee may install a suitable maximum-demand recorder to the satisfaction of the inspecting Engineer of the Public Works Department, and rental shall be assessed on the half-hourly maximum kilowatt demand for the year at the rate of £1 per annum per kilowatt of maximum demand so recorded, or such lesser rate as may be fixed after compliance by the licensee with the said regulations. Failing such installation, rental shall be determined on the maximum capacity of the generating plant installed. The present plant is rated at 350 kilowatts.

  1. TELEGRAPH LINES.

The licensee shall rectify to the satisfaction of the Minister of Public Works any interference or disturbance caused by the erection or operation of the licensee’s system that affects the satisfactory working of the telegraph lines which are the property of the Post and Telegraph Department and which were erected prior to the licensee’s lines.

SECOND SCHEDULE.

PART A.

(1) THE electric lines within the outer area of the Otago Central Electric-power District, following generally the Kingston—Queenstown Main Highway between the Wye Creek Power-house and the southern boundary of that portion of the Otago Central Electric-power District which formerly comprised the Lake Wakatipu Electric-power District (hereinafter called the “Lake Wakatipu Area”).

(2) The electric lines within the Lake Wakatipu area shown by means of blue, red, and broken red lines on plan P.W.D. 109542.

(3) The electric lines within the outer area of the Otago Central Electric-power District, generally following the Kawarau Gorge between the Roaring Meg Power-house and the eastern boundary of the Lake Wakatipu area, shown by means of blue and red lines on plan P.W.D. 109542.

Such of the electric lines as may be constructed between the Roaring Meg Power-house and the confluence of the Arrow and Kawarau Rivers shall be distant from the existing lines of the Post and Telegraph Department by not less than the distances shown on the said plan 109542.

PART B.

Such distribution and service lines branching from the said electric lines as may from time to time be necessary for the distribution of electrical energy within the Lake Wakatipu area and reasonably incidental to the electrical works authorized by this license.

PART C.

All other electrical works reasonably incidental to the construction and use of the above-mentioned lines or any of them.

THIRD SCHEDULE.

THE Order in Council dated the 29th day of June, 1938, and published in the Gazette of the 30th day of the same month at page 1543, authorizing the Goldfields Dredging Company, Limited, to erect certain electric lines in portion of the Lake County.
