Authorizing the Laying-off of a Street off Ventnor Road, in the City of Auckland, of a Width less than 66 ft. but not less that 54 ft., subject to a Condition as to the Building-line.

At the Government House at Wellington, this 17th day of September, 1941.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers vested in him by the Municipal Corporations Act, 1933, and the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the Auckland City Council to permit the laying-off of the proposed street described in the Schedule hereto of a width less than sixty-six feet but not less than fifty-four feet, subject to the condition that no building or part of a building shall at any time be erected on the land fronting the said street within a distance of forty-eight feet from the centre-line of the said street.
SCHEDULE.
THAT proposed street, in the North Auckland Land District, City of Auckland, containing by admeasurement 2 roods 8 perches, more or less, being part Lot D on D.P. 6608, and being part Allotments 147 and 148, Section 16, Suburbs of Auckland. As the same is more particularly delineated on the plan marked P.W.D. 110975, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

As the same is more particularly delineated on the plan marked P.W.D. 111705, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The Western Side of Portion of Opawa Street and the Southern Side of Portion of Stephenson (or Stephen) Street East, in the County of Marlborough, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this 17th day of September, 1941.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Marlborough County Council on the eleventh day of July, one thousand nine hundred and forty-one (in so far as it affects the sides and portions of roads described in the Schedule hereto), viz. :—
“The Marlborough County Council, having control of the roads known as Opawa Street and Stephenson (otherwise Stephen) Street East, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the portion of Opawa Street fronting Lot 7 and part Lot 3 of Section 45, Opawa, being 994 links in length, and being the land contained in Certificates of Title, Volume 1, folio 222, and Volume 8, folio 241, nor to the portion of Stephenson (or Stephen) Street East fronting parts of Lot 3 of 45, Opawa, being 905 links in length, and being the land contained in Certificates of Title, Volume, 8, folio 241, and Volume 10, folio 255, and the balance of land in Certificate of Title, Volume 10, folio 256, the said Section 45, Opawa, being situated in Block XVI, Cloudy Bay Survey District ”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side of the portion of Opawa Street, or the southern side of the portion of Stephenson (or Stephen) Street East (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of roads.
SCHEDULE.
THE western side of all that portion of road, situated in the Marlborough Land District, County of Marlborough, known as Opawa Street, fronting Lot 7 and part Lot 3, D.P. 5, being part Section 45, Opawa District, Borough of Blenheim.
Also the southern side of all that portion of road, situated in the said land district and county, known as Stephenson (or Stephen) Street East, fronting parts Lot 3, D.P. 5, part Section 45, Opawa District, Borough of Blenheim.
As the same are more particularly delineated on the plan marked P.W.D. 112033, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured brown.

IN pursuance and exercise of the powers and authorities conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the land described in the Schedule hereto being taken for housing purposes, together with the right of way over Lot 6, D.P. 4696, and the water rights over part Lot 4, D.P. 4696, and part Lot 3, D.P. 4696, created by Memorandum of Transfer No. 46191, Hawke’s Bay Registry, and subject as to part to the grant of a pipe-line easement appurtenant to Lot 1, D.P. 4696, created by the said Memorandum of Transfer No. 46191.
SCHEDULE.
APPROXIMATE area of the piece of land permitted to be taken: 1 road 20 perches.
Being part Suburban Section 14, Awatoto, being Lot 2, D.P. 4696.
