  1. If, by resignation, death, incapacity, or otherwise, the seat of any member shall be or become vacant, or if any member absents himself, without reasonable cause, from three consecutive meetings of the Board, the Governor-General shall have power to appoint any other person to be a member of the Board in his (or her) stead.

  2. All questions shall be determined by the majority of votes of the members of the Board present at a meeting.

  3. The Board shall have prepared and submitted at an annual meeting held in the month of April in each year a report of the proceedings of the Board for the previous year ending on the thirty-first day of March, together with a statement of the receipts and expenditure of the Board for such year. A copy of every such report and statement, certified by the Chairman to be correct, shall be sent to the Minister of Lands as soon as possible after each annual meeting.

The Northern Side of Portion of Westby Street, in the City of Christchurch, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 6th day of August, 1941.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Christchurch City Council on the ninth day of June, one thousand nine hundred and forty-one, the portion of street being more particularly described in the Schedule hereto, viz. :—

“ The Christchurch City Council, having control of the streets in the City of Christchurch, hereby declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the northern side of the portion of Westby Street, adjoining the land comprised in Certificate of Title, Volume 224, folio 237, being Lot 3, D.P. 417, and being part of R.S. 48A ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the northern side of the portion of Westby Street (described in the Schedule hereto), within a distance of thirty-five feet from the centre-line of the said portion of street.

SCHEDULE.

THE northern side of all that portion of street, situated in the Canterbury Land District, City of Christchurch, known as Westby Street, fronting part Lot 3, D.P. 417, being part R.S. 48A, Block XV, Christchurch Survey District. As the same is more particularly delineated on the plan marked P.W.D. 111445, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

“ That the Green Island Borough Council, being the local authority having control of the streets in the Borough of Green Island, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the northern side of the portion of District Road and the southern side of the portion of Kirkland Street adjoining Allotments 48/57, Block III, Township of Green Island ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the northern side of the portion of District Road, or the southern side of the portion of Kirkland Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-lines of the said portions of streets.

SCHEDULE.

THE northern side of all that portion of street, situated in the Otago Land District, Borough of Green Island, known as District Road, fronting Lots 49, 51, 53, 55, and 57, Block III, D.P. 44, Township of Green Island.

Also the southern side of all that portion of street, in the said land district and borough, known as Kirkland Street, fronting Lots 48, 50, 52, 54, and 56, Block III, D.P. 44, Township of Green Island.

As the same are more particularly delineated on the plan marked P.W.D. 111650, deposited in the office of the Minister of Public Works at Wellington, and thereon edged red.

The North-eastern Side of Portion of the Richmond–Collingwood State Highway exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

“ The Main Highways Board, being the authority having control of the Richmond–Collingwood State Highway, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the north-eastern side of the portion of the said highway fronting part Section 66, District of Takaka, Block V, Waitapu Survey District, contained in Certificate of Title, Volume 66, folio 111 ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-eastern side of the portion of the Richmond–Collingwood State Highway (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of road.

THE north-eastern side of all that portion of the Richmond–Collingwood State Highway, situated in the Nelson Land District, County of Takaka, fronting part Section 66, District of Takaka, Block V, Waitapu Survey District. As the same is more particularly delineated on the plan marked P.W.D. 111444, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.
