The Southern Side of Portion of Fulford Street, and the Eastern Side of Portion of Mount Edgecumbe Street, in the Borough of New Plymouth, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 4th day of June, 1941.

Present:
THE HON. W. NASH PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the New Plymouth Borough Council on the seventeenth day of February, one thousand nine hundred and forty-one, viz.:

“The New Plymouth Borough Council, being the local authority having control of the streets in the Borough of New Plymouth, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply—

“(a) To the southern side of the portion of Fulford Street adjoining Section 398, Town of New Plymouth, Certificate of Title, Volume 13, folio 300, Taranaki Registry: nor

“(b) To the eastern side of the portion of Mount Edgecumbe Street adjoining the said Section 398, New Plymouth”;

the sides and portions of streets affected by such resolution being described in the Schedule hereto; subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side of the portion of Fulford Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

The southern side of all that portion of street, situated in the Taranaki Land District, Borough of New Plymouth, known as Fulford Street, fronting Section 398, Town of New Plymouth.

Also the eastern side of all that portion of street in the said land district and borough known as Mount Edgecumbe Street fronting the said Section 398.

As the same are more particularly delineated on the plan marked P.W.D. 110711, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Appointing a Member of the Patea Harbour Board.

HIS Excellency the Governor-General of the Dominion of New Zealand, in exercise of the power and authority conferred upon him by section twenty-eight of the Harbours Act, 1923, and of all other powers and authorities enabling him in that behalf, doth hereby appoint

Frederick Ramsbottom

to be a member of the Patea Harbour Board as a representative of the electors of the combined district of the Patea Borough and the Waverley Town District Subdivision of the Patea Harbour District, to fill an extraordinary vacancy on the Board caused by the failure of the said combined district to elect the required number of representatives.

As witness the hand of His Excellency the Governor-General, this 7th day of June, 1941.

Judge of Assessment Court under the Urban Farm Land Rating Act, 1932, appointed.

PURSUANT to section nine of the Urban Farm Land Rating Act, 1932, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, hereby appoint

Felix Hector Levien, Esquire,
Stipendiary Magistrate, Auckland, to be the Judge of the Assessment Court for the City of Auckland.

As witness the hand of His Excellency the Governor-General, this 7th day of June, 1941.

HIS Excellency the Governor-General has been pleased, in pursuance of the provisions of section 12 of the Magistrates’ Courts Act, 1928, to appoint

Charles Rutherford Orr Walker, Esquire,

to be a Stipendiary Magistrate to exercise criminal and civil jurisdiction within New Zealand for the period from the 5th day of June, 1941, to the 4th day of June, 1942, or until such earlier date upon which the said Charles Rutherford Orr Walker may cease to hold office as Chairman of the Auckland Armed Forces Appeal Board.

IN pursuance and exercise of the powers conferred on me by section three, subsection one, of the Lower Clutha River Improvement Act, 1938, I, Hubert Thomas Armstrong, the Minister of Public Works, do hereby appoint—

Andrew Alex Jensen, of Stirling, Farmer, and
John Graham Weir, of Stirling, Farmer,

to be Commissioners of the Lower Clutha River Trust.
