Notice of Provisional Plan for Electric-range Manufacturing Industry.

In the matter of the Industrial Efficiency Act, 1936.

WHEREAS pursuant to section 9 of the above-entitled Act, the Minister of Industries and Commerce instructed the Bureau of Industry to prepare an industrial plan for the organization of the industry referred to in a notice given by the Minister pursuant to section 14 of the Industrial Efficiency Act, 1936, on the 4th day of December, 1936, and published in the Gazette on the 10th day of December, 1936, and therein described as the “Manufacture of electric ranges, including the assembly of parts thereof”; And whereas the Bureau thereupon proceeded to prepare a provisional plan and submitted the same to the Minister; And whereas in the opinion of the Minister the appointment of a Special Industrial Committee is desirable in connection with the said industrial plan:

Now, therefore, pursuant to the said Act, the Minister hereby gives public notice that the material proposals contained in the plan are as follows:—

  1. The organization of the industry will be effected by means of:—

(a) The maintenance of the licensing system now in force.

(b) The continued application to the said industry of the Licensed Industries General Regulations 1940 as modified by the proposed special regulations herein-after referred to.

(c) The appointment of an Industrial Committee not exceeding seven members in manner to be prescribed by the proposed special regulations.

  1. The notice published in the Gazette on the 10th day of December, 1936, referred to above, so far as it relates to the industry aforesaid, will continue in force with the consequence that the industry will be able to be carried on only pursuant to a license issued under Part III of the said Act and in conformity with the terms and conditions of such license.

  2. The Minister will respectfully recommend the Governor-General to make regulations in the terms set out in the Schedule hereto (herein called “the proposed special regulations”), and will move the Executive Council to give its advice and consent to the making of the proposed special regulations.

  3. In accordance with the provisions of section 9 of the said Act, the regulations in relation to the plan, as finally approved by the Minister, will not be brought into force unless the Governor-General in Council is satisfied that the material proposals contained in the plan and in the regulations have been submitted to and have been approved by a majority of the persons engaged as principals in the industry or have been approved by persons employing a majority of the workers engaged in the industry.

And it is further notified that the Minister will forthwith after the 29th day of May, 1941, refer to the Bureau for consideration any recommendations or objections relating to this provisional plan that may be received by him pursuant to the said Act, and all such recommendations or objections should accordingly be delivered to the Minister not later than the last-mentioned date.

SCHEDULE.

PROPOSED SPECIAL REGULATIONS.

  1. These regulations may be cited as the Industrial Efficiency (Electric Range) Regulations 1941.

  2. These regulations shall be deemed to be special regulations within the meaning of the Licensed Industries General Regulations 1940 (hereinafter called “the general regulations”), which shall apply as hereby modified in relation to the industry referred to in the next succeeding regulation.

  3. These regulations shall apply in relation to the industry referred to in a notice given by the Minister pursuant to section 14 of the Industrial Efficiency Act, 1936, on the 4th day of December, 1936, and published in the Gazette on the 10th day of December, 1936, and therein described as follows: “Manufacture of electric ranges, including the assembly of parts thereof.”

  4. Subject to Regulation 2:9 of the general regulations the Committee shall consist of such number of persons as the Minister from time to time thinks fit to appoint, not being more than seven nor less than four in number.

  5. Subject to Regulations 7 and 8 hereof the Minister shall, before making any appointment of a person to be a member of the Committee, give public notice in the Gazette notifying his intention to make such appointment and calling upon licensees to submit to him in writing not later than a date to be specified in the notice and to be at least three weeks after the date of the first publication of the notice the names of persons to be appointed.

  6. Subject to Regulations 7 and 8 hereof the Minister shall not make any appointment to the Committee until after the date specified in the notice published pursuant to Regulation 5 hereof, and shall not appoint to be a member of the Committee any person whose name has not been submitted to him pursuant to notice given under Regulation 5 hereof.

  7. Regulations 5 and 6 hereof shall not apply to an appointment at the time of which there are at least four continuing or concurrently appointed members of the Committee who prior to appointment have been nominated pursuant to Regulation 5 hereof.

  8. Regulations 5 and 6 hereof shall not apply to an appointment by way of reappointment of a person whose period of membership is expiring if every licensee signifies to the Minister, with such formality as the Minister thinks sufficient, the acquiescence of the licensee in the proposed reappointment.

  9. Every appointment to membership of the Committee shall take effect on the day on which notice of the appointment is published in the Gazette, or any later date specified or referred to in such notice.

  10. Every member of the Committee shall hold office during the Minister’s pleasure, so that he may at any time be removed from office by the Minister by notice in writing published in the Gazette.

  11. Subject to the last preceding regulation every member of the Committee, appointed after compliance with the formalities prescribed by Regulations 5 and 6 or Regulation 8 hereof, shall hold office for a term to be specified in the instrument of appointment and the notice thereof published in the Gazette and not to exceed thirteen months.

  12. It shall be lawful for the Committee acting under Regulation 2:8 of the General Regulations to make by-laws enabling members or any specified members of the Committee to attend and vote by proxies appointed in such manner as the by-laws may provide.

Notice as to the Control of certain Factory and Building Materials.

PURSUANT to the Supply Control Emergency Regulations 1939, the Building Emergency Regulations 1939, and the Factory Emergency Regulations 1939, I hereby direct that no person shall, except with the precedent consent of the Building Controller, or the Factory Controller, use any wrought-iron tubes or steel tubes otherwise than for the conveyance of gas, steam, air, or liquids, but nothing in this paragraph shall be deemed to prohibit the use of screwed steel conduit for the enclosure of electrical cables if such use is in accordance with the Building Construction Control Notice No. 1, 1941.*

Pursuant to the Supply Control Emergency Regulations 1939, the Factory Emergency Regulations 1939, and the Building Emergency Regulations 1939, I do hereby give notice that the Notice as to the Control of certain Factory and Building Materials given by me on 20th December, 1939,† is hereby amended by revoking paragraph 1 of the Schedule to the said notice.

Approval of Testing Officers under the Motor-drivers Regulations 1940.

IN terms of Regulation 5 of the Motor-drivers Regulations 1940, the Minister of Transport does hereby approve, until further notice, of the persons named in Column 2 of the Schedule hereunder being Testing Officers under the said regulations for the authority specified in Column 1 of the said Schedule.
