resolution passed by the New Plymouth Borough Council on the third day of February, one thousand nine hundred and forty-one, viz. :

“ That the New Plymouth Borough Council, being the local authority having control of the street herein-after mentioned, hereby resolves and declares that the provisions of section one hundred and twenty-eight, subsection one, of the Public Works Act, 1928, shall not apply to the eastern side of Hobson Street to which Lot 31, D.P. No. 2621, being part Sections 1966 and 1967, New Plymouth, has frontage ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the eastern side of the portion of Hobson Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE eastern side of all that portion of street situated in the Taranaki Land District, Borough of New Plymouth, known as Hobson Street, fronting Lot 31, D.P. No. 2621, being part of Sections 1966 and 1967, Town of New Plymouth. As the same is more particularly delineated on the plan marked P.W.D. 110791, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The Northern Side of Portion of Muir Street and the Eastern Side of Portion of George Street, in the Borough of Green Island, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

At the Government Buildings at Wellington, this 7th day of May, 1941.

Present:

THE HON. W. NASH PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Green Island Borough Council on the eighteenth day of March, one thousand nine hundred and forty-one, in so far as it affects the sides and portions of streets described in the Schedule hereto, viz. :

“ That the Green Island Borough Council, being the local authority having control of the streets in the Borough of Green Island, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of Muir Street adjoining Allotment 65, and George Street adjoining Allotments 65 and 66, Township of Green Island ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the northern side of the portion of Muir Street, or the eastern side of the portion of George Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-lines of the said portions of streets.

SCHEDULE.

THE northern side of all that portion of street, situated in the Otago Land District, Borough of Green Island, known as Muir Street, fronting Allotment 65, Block I, D.P. 44, Township of Green Island, being also part Section 78, Lower Kaikorai District.

Also that eastern side of all that portion of street, situated in the said land district and borough, known as George Street, fronting Allotments 65 and 66, Block I, D.P. 44, Township of Green Island, and being also part Section 78, Lower Kaikorai District.

As the same are more particularly delineated on the plan marked P.W.D. 110326, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

“ The Auckland City Council, being the local authority having control of the streets in the City of Auckland, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of Cheeseman Street adjoining Lot 5, part Allotment 13, Section 8, Suburbs of Auckland, comprised in Certificate of Title, 87/77 ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-eastern side of the portion of Cheeseman Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of street.

THE north-eastern side of all that portion of street situated in the North Auckland Land District, City of Auckland, known as Cheeseman Street, fronting Lot 5, D.P. 1851, being part Allotment 13, Section 8, Suburbs of Auckland. As the same are more particularly delineated on the plan marked P.W.D. 110671, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

“ That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the north-western side of portion of Carlton Street adjoining Lots 4, 5, and 6, Block II, Township of Ascotvale, and being the land comprised and described in Certificate of Title, Register Book, Volume 205, folio 260 ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-western side of the portion of Carlton Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of street.
