The North-western Side of Portion of Thirlstane Street and the
South-western Side of Portion of Winton Street, in the City
of Dunedin, exempted from the Provisions of Section 128 of
the Public Works Act, 1928, subject to a Condition as to the
Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 18th day of
September, 1940.

Present :

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the
Public Works Act, 1928, and of all other powers in
anywise enabling him in this behalf, His Excellency the
Governor-General of the Dominion of New Zealand, acting
by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby approve of the following
resolution passed by the Dunedin City Council on the ninth
day of October, one thousand nine hundred and thirty-nine,
viz. :—

“That the Dunedin City Council, being the local
authority having control of the streets in the City of
Dunedin, by resolution declares that the provisions of
section one hundred and twenty-eight of the Public
Works Act, 1928, shall not apply to the undermentioned
portions of streets, viz. :—

“(a) The north-western side of portion of Thirlstane
Street, abutting on Lots 78–84 and part
Lot 85, Block III, Township of Dalkeith ;

“(b) The south-western side of portion of Winton
Street, abutting on Lots 89–108, Block III,
Township of Dalkeith ” ;

subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the north-
western side of the portion of Thirlstane Street or the south-
western side of the portion of Winton Street (described in the
Schedule hereto) within a distance of thirty-three feet from
the centre-lines of the said portions of streets.

SCHEDULE.

The north-western side of all that portion of street, situated
in the Otago Land District, City of Dunedin, known as
Thirlstane Street, fronting Lots 78, 79, 80, 81, 82, 83, and 84,
and part Lot 85, Block III, D.P. 179, Township of Dalkeith,
being parts Sections 34 and 36 North-east Valley District.

Also the south-western side of all that portion of street, in
the said land district and city, known as Winton Street,
fronting Lots 89, 90, 91, 92, 93, 94, 95, 96, 97, 98, 99, 100,
101, 102, 103, 104, 105, 106, 107, and 108, Block III, D.P. 179,
Township of Dalkeith, being parts Section 47, North Harbour
and Blueskin District.

As the same are more particularly delineated on the plan
marked P.W.D. 105970, deposited in the office of the Minister
of Public Works at Wellington, and thereon coloured red.

ORDER IN COUNCIL.

At the Government House at Wellington, this 18th day of
September, 1940.

Present :

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers and authorities
vested in him by section one hundred and thirty-nine
of the Municipal Corporations Act, 1933, and of all other
powers and authorities in anywise enabling him in this
behalf, His Excellency the Governor-General, acting by and
with the advice and consent of the Executive Council, doth
hereby declare that the boundaries of the City of Christchurch
are hereby altered so as to include therein and exclude from the
County of Heathcote the land described in the Schedule
hereto, being land in the said County in respect of which there
are no electors.

SCHEDULE.

AREA EXCLUDED FROM COUNTY OF HEATHCOTE AND INCLUDED
IN THE CITY OF CHRISTCHURCH.

All that area of land in the Canterbury Land District
bounded by a line commencing at the intersection of the
production of the western side of Kerrs Road and the right
bank of the River Avon (being a point on the boundary of the
City of Christchurch) ; proceeding thence northerly by a
right line to the centre of the River Avon ; thence generally
easterly along the centre of the River Avon to a point on the
south-eastern side of the Bower Bridge ; thence north-easterly
along the south-eastern side of that bridge to the left bank of
the River Avon (being a point on the boundary of the New
Brighton Borough) ; thence south-easterly along that
boundary to a point distant 2 chains south-east of the south-
eastern side of the Bower Bridge ; thence south-westerly by a
right line parallel to and distant 2 chains from the south-
eastern side of that bridge to the south-western side of the
towpath ; thence generally westerly along the southern side
of the towpath to Wainoni Road ; thence continuing along
the southern side of Wainoni Road and Avonside Drive across
Kerrs Road to the City boundary ; thence northerly by a
right line to the commencing point ; being more particularly
delineated and coloured pink on a plan marked I.A. 104/10
and deposited in the office of the Department of Internal
Affairs, Wellington.

Directing Sale of Railway Land at Westfield under the Public
Works Act, 1928.

ORDER IN COUNCIL.

At the Government House at Wellington, this 11th day
of September, 1940.

Present :

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by the thirty-fifth section of the Public
Works Act, 1928 (hereinafter termed “the said
Act”), it is enacted that if it is found that any land held,
taken, purchased, or acquired at any time under this or any
other Act or Provincial Ordinance, or otherwise howsoever,
for any public work, is not required for such public work,
the Governor-General may, by Order in Council publicly
notified and gazetted, cause the same to be sold under the
condition set forth in the said Act :

Now, therefore, His Excellency the Governor-General of
the Dominion of New Zealand, in pursuance of the powers
and authorities conferred upon him by the said Act, and
acting by and with the advice and consent of the Executive
Council of the said Dominion, doth hereby order and direct
the sale of the land described in the Schedule hereto.

Wellington, and thereon coloured yellow.

IN pursuance and exercise of the powers conferred by
section forty-four of the Public Reserves, Domains, and
National Parks Act, 1928, His Excellency the Governor-
General of the Dominion of New Zealand, acting by and with
the advice and consent of the Executive Council of the said
Dominion, doth hereby appoint

Talbot George Bowman,
Richard Dunn Leslie,
William Romaine Dowson, and
Joseph Archibald McClean

to be the Kaiwaka Park Domain Board, having control of
the land described in the Schedule hereto ; and doth hereby
appoint Saturday, the twelfth day of October, one thousand
nine hundred and forty, at eight o’clock p.m., as the time
when, and the Kaiwaka Public Hall, as the place where,
the first meeting of the Board shall be held.
