Consenting to the Raising of Loans of £2,000 and £2,650 by the Manukau County Council and prescribing the Conditions thereof.

ORDER IN COUNCIL.
At the Government House at Wellington, this 14th day of August, 1940.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS the Manukau County Council, being desirous of raising the loans set out in the first column of the Schedule hereto, has complied with the provisions of the Local Government Loans Board Act, 1926 (hereinafter called “the said Act”), and it is expedient that the precedent consent of the Governor-General in Council, as required by the said Act, should be given to the raising of the said loans:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the said Act, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby consent to the raising in New Zealand by the said local authority of the loans set out in the first column of the said Schedule, up to the respective amounts specified in the second column of the said Schedule, and in giving such consent doth hereby determine as follows:—

The terms for which the said loans or any parts thereof may be raised shall be the respective terms (in years) stated in the third column of the said Schedule.

The rates of interest that may be paid in respect of the said loans or any parts thereof shall be such as shall not produce to the lender or lenders a rate or rates exceeding the respective rates per centum per annum stated in the fourth column of the said Schedule.

Each of the said loans shall be repaid as follows:—
(a) By thirty equal payments of the amount stated in the fifth column of the said Schedule opposite each such loan, one of such payments to be made at the end of every half-year commencing from the date on which the said loans are respectively raised. Each such half-yearly payment shall be applied firstly in payment of interest computed at the rate of four pounds (£4) per centum per annum on the amount of principal for the time being outstanding at the beginning of each half-year in respect of each respective loan and the balance of such half-yearly payment in reduction of such principal.
(b) By a payment at the end of the fifteenth year from the date of the raising of each of the said loans of a sum equal to the amount to which the principal of the said loans has been reduced in accordance with the preceding paragraph (a) hereof after payment of the aforesaid thirty (30) respective half-yearly payments. -
The payment of such instalments shall be made in New Zealand and no such instalments shall be paid out of loan-moneys.

The rate payable for brokerage, underwriting, and procurement fees in respect of the raising of the said respective loans, or any parts thereof shall not in the aggregate exceed one-half per centum of any amount raised.

No moneys shall be borrowed under this consent after the expiration of two years from the date hereof.

Postponing General Election of Members of Christchurch Tramway Board.
GALWAY, Governor-General.
ORDER IN COUNCIL.
At the Government House at Wellington, this 21st day of August, 1940.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers and authorities vested in him by section forty of the Statutes Amendment Act, 1939, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby further postpone the holding of the general election of members of the Christchurch Tramway Board; and doth hereby order and declare that the said general election shall be held and take place on Wednesday, the fourteenth day of May, one thousand nine hundred and forty-one.

Revoking Order in Council delegating Powers under the Cemeteries Act, 1908.

ORDER IN COUNCIL.
At the Government House at Wellington, this 14th day of August, 1940.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred on him by the Cemeteries Act, 1908, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the Order in Council made on the sixth day of January, one thousand eight hundred and ninety-four, and published in the Gazette on the eleventh day of the same month, at page 56, in which the power of appointing and removing trustees for the Duvauchelle Bay Cemetery was delegated to the Akaroa County Council.
