conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary certain of the determinations aforesaid in respect of the said sum by prescribing as follows :—
(1) In lieu of a term of thirty (30) years as specified in clause one of the Order in Council made on the fifteenth day of March, one thousand nine hundred and thirty-nine, the term shall not exceed twenty-five (25) years.
(2) In lieu of a rate of interest not exceeding four pounds five shillings (£4 5s.) per centum per annum as specified in the said Order in Council made on the nineteenth day of July, one thousand nine hundred and thirty-nine, the rate of interest that may be paid in respect of the said sum shall be such as shall not produce to the lender or lenders a rate exceeding four pounds (£4) per centum per annum.
(3) In lieu of making provision for the repayment of the said sum by establishing a sinking fund in respect thereof as specified in clause three of the Order in Council made on the fifteenth day of March, one thousand nine hundred and thirty-nine, the said local authority may raise the said sum upon terms of making the same, together with interest thereon, repayable by equal aggregate annual or half-yearly instalments extending over the term as determined in (1) above.

  • Licensing Rawene Motors, Limited, to use a Part of the Foreshore and Land below Low-water Mark at Rawene, Hokianga Harbour, as a Site for a Platform, Wharf, and Engine-shed.

ORDER IN COUNCIL.
At the Government House at Wellington, this 3rd day of July, 1940.

Present :

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

PURSUANT to the Harbours Act, 1923, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby license and permit Rawene Motors, Limited (hereinafter called “the company,” which term shall include its successors or assigns unless the context requires a different construction), to use and occupy a part of the foreshore and land below low-water mark at Rawene, Hokianga Harbour, at the site marked No. 36, as shown on plan marked M.D. 6176, approved on the twenty-eighth day of June, one thousand nine hundred and twenty-six, and deposited in the office of the Marine Department at Wellington, for the purpose of maintaining thereon a platform, wharf, and engine-shed (hereinafter referred to as “the said structures”) as shown on the said plan, such license to be held and enjoyed by the company upon and subject to the terms and conditions set forth in the Schedule hereto.

SCHEDULE.

  1. This license is subject to the Foreshore License Regulations 1940, and the provisions of those regulations shall, so far as applicable, apply hereto.
  2. The term of the license shall be fourteen years from the 28th June, 1940.
  3. The premium payable by the licensee shall be £1 and the annual sum so payable £5.

  • Declaring Portion of Road in the Borough of Feilding to be under the Control and Management of the Feilding Borough Council.

ORDER IN COUNCIL.
At the Government House at Wellington, this 3rd day of July, 1940.

Present :

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers vested in him by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the portion of road described in the Schedule hereto shall, on and after the date of this Order in Council, be under the control and management of the Feilding Borough Council.

SCHEDULE.

APPROXIMATE area of the portion of road dealt with : 28·68 perches.

Being road by Proclamation published in New Zealand Gazette, 1940, page 1120 (formerly part Lot 701 on D.P. 19, being part Subdivision A, Manchester Block).

Situated in Block XIV, Oroua Survey District (Borough of Feilding). (S.O. 20326.)

In the Wellington Land District; as the same is more particularly delineated on the plan marked P.W.D. 106814, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

  • The South-western Side of Portion of Chapel Street, in the City of Dunedin, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this 3rd day of July, 1940.

Present :

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the sixth day of November, one thousand nine hundred and thirty-nine, viz. :—

“That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the south-western side of portion of Chapel Street abutting on parts of Lots 23 and 24, D.P. 49, Village of Kirkland Hill ”; subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-western side of the portion of Chapel Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE south-western side of all that portion of street situated in the Otago Land District, City of Dunedin, known as Chapel Street, fronting parts Lots 23 and 24, D.P. 49, Village of Kirkland Hill. As the same is more particularly delineated on the plan marked P.W.D. 107419, deposited in the office of the Minister of Public Works at Wellington, and thereon edged red.
