The Arms Emergency Regulations 1940.

ORDER IN COUNCIL.

At the Government House at Wellington, this 2nd day of July, 1940.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

PURSUANT to the Emergency Regulations Act, 1939, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby make the following regulations.

REGULATIONS.

  1. These regulations may be cited as the Arms Emergency Regulations 1940.

  2. In these regulations, unless the context otherwise requires,—
    “ Alien ” has the same meaning as in the Alien Control Emergency Regulations 1939 :
    “ The Arms Act ” means the Arms Act, 1920, and its amendments : Expressions defined in the Arms Act have the meanings so defined.

  3. Notwithstanding anything to the contrary in the Arms Act or in any regulations or notice thereunder, section 7 of the Arms Act shall apply with respect to—
    (a) The possession by an alien of any shot-gun or ammunition of a kind referred to in subsection (3) of the said section 7, or in section 8 of the Arms Amendment Act, 1921–22 :
    (b) The possession by any person other than a licensed dealer of any explosives of a kind referred to in the said subsection (3) of section 7 of the Arms Act.

  4. Notwithstanding anything to the contrary in subsection (8) of section 9 of the Arms Act, that section shall apply with respect to the possession by an alien of any shot-gun of a kind referred to in the said subsection (8).
