At the Government House at Wellington, this 19th day of June, 1940.

Present:

His EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers and authorities conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the Hokiang County Council stopping the portion of road described in the Schedule hereto.

SCHEDULE.

APPROXIMATE area of the piece of road permitted to be stopped: 3 roods 13 perches.

Adjoining Section 95, Block IX, Waoku Survey District (Auckland R.D.). (S.O. 29333.)

In the North Auckland Land District; as the same is more particularly delineated on the plan marked P.W.D. 10587), deposited in the office of the Minister of Public Works at Wellington, and thereon coloured green.

IN pursuance and exercise of the powers and authorities conferred upon him by the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby direct the sale of the land described in the Schedule hereto, such land being no longer required for the public work for which it was acquired.

The Eastern Side of Portion of Grey Street, and the Southern Side of Portion of Pah Street, in the Borough of Motueka, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 19th day of June, 1940.

Present:

His EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Motueka Borough Council on the nineteenth day of February, one thousand nine hundred and forty, viz.:

“That the Motueka Borough Council, being the local authority controlling the streets in the Borough of Motueka, hereby declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of the southern and eastern halves of Pah Street and Grey Street fronting the northern and western boundaries respectively of Lot 1, D.P. 1575, being part Section 161, N.R., District of Motueka, Block IV, Motueka Survey District”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the eastern side of the portion of Grey Street, or the southern side of the portion of Pah Street (described in the Schedule hereto) within a distance of thirty-five feet from the centre-lines of the said portions of streets.

SCHEDULE.

THE eastern side of all that portion of street, situated in the Nelson Land District, Borough of Motueka, known as Grey Street, fronting Lot 1, D.P. 1575, being part Section 161 (Native Reserve), District of Motueka.

Also the southern side of all that portion of street, situated in the said land district and borough, known as Pah Street, fronting Lot 1, D.P. 1575, being part Section 161 (Native Reserve), District of Motueka.

As the same are more particularly delineated on the plan marked P.W.D. 107342, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.
