Price Order No. 4.
In pursuance of the powers conferred upon the Price Tribunal by the Control of Prices Emergency Regulations 1939, and with the authority of the Minister of Industries and Commerce, the Price Tribunal hereby makes the following Price Order:—

This Order may be cited as Price Order No. 4.

This Order shall take effect as from the 18th day of June, 1940.

In this Order, unless the context otherwise requires,—
“Potatoes” means and includes potatoes grown in New Zealand, but does not include potatoes planted after the 1st day of May, 1940, or potatoes sold for seed purposes:
“Fair average quality” means potatoes of table size, good quality, and reasonably free from earth. A tolerance not exceeding in the aggregate 4 per cent. by weight will be allowed for small potatoes, diseased or insect-affected tubers, or tubers damaged by frost or mechanical injury:
“Sale by wholesale” means every sale made to any person for the purpose of resale, and includes a sale by public auction.
- The maximum price of potatoes of fair average quality when sold by way of sale by wholesale shall not exceed £4 10s. per ton for delivery f.o.b. South Island ports, sacks included:
Provided, first, if sold for delivery at any other place an equivalent reduction in the price aforesaid shall be made in any case where the charges for reasonable transport, handling, and incidental costs (including reasonable selling margins) are less than those when sold for delivery f.o.b. South Island ports:
Provided, secondly, if sold for delivery at any other place an equivalent addition to the price aforesaid may be made in any case where the charges for reasonable transport, handling, and incidental costs (including reasonable selling margins) are greater than those when sold for delivery f.o.b. South Island ports.
- Nothing hereinbefore contained shall apply to potatoes which have become the subject of any contract for sale and purchase prior to the making of this Order, subject to the condition that any such contract for sale and purchase shall be open at all reasonable times to the inspection of the Price Tribunal or of any officer of the Price Tribunal appointed by it to make inspection thereof.
