Declaring Portions of Road in the Borough of Mount Albert
to be under the Control and Management of the Mount
Albert Borough Council.
GALWAY, Governor-General.
ORDER IN COUNCIL.
At the Government House at Wellington, this 12th day of
June, 1940.
Present:
His Excellency THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers vested in him
by the Public Works Act, 1928, and of all other powers
in anyway enabling him in this behalf, His Excellency the
Governor-General of the Dominion of New Zealand, acting
by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby order and declare that
the portions of road described in the Schedule hereto shall, on
and after the date of this Order in Council, be under the
control and management of the Mount Albert Borough
Council.

Investment of Timaru Harbour Board Equalization Fund.
GALWAY, Governor-General.
ORDER IN COUNCIL.
At the Government House at Wellington, this 5th day of
June, 1940.
Present:
His Excellency THE GOVERNOR-GENERAL IN COUNCIL.
HIS Excellency the Governor-General of the Dominion
of New Zealand, in pursuance and exercise of the
power and authority conferred upon him by paragraph (d)
of subsection one of section eleven of the Harbours Amend-
ment Act, 1933, and acting by and with the advice and
consent of the Executive Council of the said Dominion, doth
hereby authorize the Timaru Harbour Board Commissioners
to invest the Equalization Fund of the Timaru Harbour
Board in debentures of any of the local bodies named in
paragraph (c) of subsection one of section ninety-five of the
Trustee Act, 1908, and the amendments thereof.

The North-eastern Side of Portion of Paraite Road, in the
County of Taranaki, exempted from the Provisions of Section
128 of the Public Works Act, 1928, subject to a Condition as
to the Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this 12th day of
June, 1940.
Present:
His Excellency THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the
Public Works Act, 1928, and of all other powers in
anywise enabling him in this behalf, His Excellency the
Governor-General of the Dominion of New Zealand, acting
by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby approve of the following
resolution passed by the Taranaki County Council on the
sixth day of November, one thousand nine hundred and
thirty-nine (in so far as it affects the side and portion of
road described in the Schedule hereto), viz. :-
"That the Taranaki County Council, being the local
authority having control of the roads within the County
of Taranaki, by resolution declares that the provisions
of section one hundred and twenty-eight of the Public
Works Act, 1928, shall not apply to that portion of the
Paraite Road fronting part Section 14, Bell District,
Block VI, Paritutu Survey District, being all the land
shown under Certificate of Title, Volume 104, folio 272,
in the Taranaki District Lands Registry, and as more
particularly delineated on plan prepared by Messrs.
Palmer and Saxton, dated November, 1939 ";
subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the north-
eastern side of the portion of Paraite Road (described in
the Schedule hereto) within a distance of thirty-three feet
from the centre-line of the said portion of road.
SCHEDULE.
THE north-eastern side of all that portion of road situated in
the Taranaki Land District, County of Taranaki, known as
Paraite Road, fronting part Section 14, Bell District, Block
VI, Paritutu Survey District. As the same is more par-
ticularly delineated on the plan marked P.W.D. 107238,
deposited in the office of the Minister of Public Works at
Wellington, and thereon coloured yellow.
