The Enemy Trading Emergency Regulations 1939, Amendment No. 1.

ORDER IN COUNCIL.

At the Government House at Wellington, this 11th day of June, 1940.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

PURSUANT to the Emergency Regulations Act, 1939, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby make the following regulations.

REGULATIONS.

  1. These regulations may be cited as the Enemy Trading Emergency Regulations 1939, Amendment No. 1.

  2. These regulations shall be read together with and deemed part of the Enemy Trading Emergency Regulations 1939 (hereinafter referred to as the principal regulations).

  3. Regulation 1 of the principal regulations is hereby amended by revoking the definitions of the terms “enemy country” and “outbreak of war” in clause (2), and substituting the following definitions:—

“‘Enemy country’ means the territories of any State with which His Majesty is for the time being at war; and includes any territory for the time being in the occupation or under the control of any such State:

“‘Outbreak of war’, in relation to any State, means the time fixed by Proclamation as the commencement of a state of war between His Majesty and that State, and, in relation to any territory coming under the occupation or control of that State at any time subsequent to the time so proclaimed, means that subsequent time.”

  1. Regulation 1 of the principal regulations is hereby further amended by omitting from the definition of the term “alien enemy” in clause (2) the words “now at war”, and substituting the words “for the time being at war”.
