The North-eastern Side generally of Portions of a Road, in
the County of Grey, exempted from the Provisions of
Section 128 of the Public Works Act, 1928, subject to a
Condition as to the Building-line.

GALWAY, Governor-General.
ORDER IN COUNCIL.
At the Government House at Wellington, this 22nd day of
May, 1940.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the
Public Works Act, 1928, and of all other powers in any-
wise enabling him in this behalf, His Excellency the Governor-
General of the Dominion of New Zealand, acting by and
with the advice and consent of the Executive Council of the
said Dominion, doth hereby approve of the following resolution
passed by the Grey County Council on the sixteenth day of
February, one thousand nine hundred and thirty-nine (in so
far as it affects the side and portions of the road described
in the Schedule hereto), viz. :
"That the Grey County Council, being the local
authority having the control of the roads in the County
of Grey, by resolution declares that the provisions of
section one hundred and twenty-eight of the Public
Works Act, 1928, shall not apply to the northern side
of the piece of road reserve fronting the southern boundary
of Section 2986, Block I, Te Miko Survey District";
subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the
north-eastern side generally of those portions of road
(described in the Schedule hereto) within a distance of thirty-
three feet from the centre-lines of the said portions of road.
SCHEDULE.
THE north-eastern side generally of all those portions of
road situated in the Westland Land District, County of
Grey, fronting Section 2986, Block I, Te Miko Survey District.
As the same is more particularly delineated on the plan
marked P.W.D. 106136, deposited in the office of the Minister
of Public Works at Wellington, and thereon coloured red.

North-western Side of Portion of Okahu Street, in the City
of Auckland, exempted from the Provisions of Section 128 of
the Public Works Act, 1928, subject to a Condition as to
the Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this 22nd day of
May, 1940.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the
Public Works Act, 1928, and of all other powers in
anywise enabling him in this behalf, His Excellency the
Governor-General of the Dominion of New Zealand, acting
by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby approve of the following
resolution passed by the Auckland City Council on the fourth
day of April, one thousand nine hundred and forty (in so far
as it affects the sides and portions of streets described in
the Schedule hereto), viz. :
"The Auckland City Council, being the local authority
having control of the streets in the City of Auckland,
by resolution declares that the provisions of section
one hundred and twenty-eight of the Public Works Act,
1928, shall not apply to that portion of Paratai Drive
adjoining Sections 258 and 259, and that portion of
Okahu Street adjoining Section 259, Town of Orakei" ;
subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the north-
eastern side of the portion of Paratai Drive and the north-
western side of the portion of Okahu Street (described in
the Schedule hereto) within a distance of thirty-three feet
from the centre-lines of the said portions of streets.

SCHEDULE.
THE north-eastern side of all that portion of street situated
in the North Auckland Land District, City of Auckland,
known as Paratai Drive, fronting Sections 258 and 259,
Town of Orakei.
Also the north-western side of all that portion of street
situated in the said land district and city fronting Section
259, Town of Orakei.
As the same are more particularly delineated on the plan
marked P.W.D. 107214, deposited in the office of the Minister
of Public Works at Wellington, and thereon coloured red.

The Northern Side of Portion of Wellington Road, in the City
of Wellington, exempted from the Provisions of Section 128
of the Public Works Act, 1928, subject to a Condition as to
the Building-line.

anywise enabling him in this behalf, His Excellency the
Governor-General of the Dominion of New Zealand, acting
by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby approve of the following
resolution passed by the Wellington City Council, on the
twelfth day of July, one thousand nine hundred and thirty-
nine, viz. :β€”
"That the Wellington City Council, being the local
authority having control of the streets in the City of
Wellington, by resolution declares that the provisions
of section one hundred and twenty-eight of the Public
Works Act, 1928, shall not apply to that part of the
northern side of Wellington Road fronting part Lot 58,
D.P. 65, comprised in Certificate of Title, Volume 398,
folio 176";
subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the northern
side of the portion of Wellington Road (described in the
Schedule hereto) within a distance of thirty-five feet from
the centre-line of the said portion of street.

SCHEDULE.
THE northern side of all that portion of street, situated in the
Wellington Land District, City of Wellington, known as
Wellington Road, fronting part Lot 58, D.P. 65, and being
part Section 4, Evans Bay District. As the same is more
particularly delineated on the plan marked P.W.D. 106653,
deposited in the office of the Minister of Public Works at
Wellington, and thereon coloured red.
