Regulations under the Naval Defence Act, 1913, amended.

GALWAY, Governor-General.

ORDER IN COUNCIL.

At the Government House at Wellington, this 14th day of May, 1940.

Present:

His Excellency The Governor-General in Council.

IN pursuance and exercise of the powers and authorities conferred on him
by section twenty-five of the Naval Defence Act, 1913, and of all
other powers and authorities enabling him in that behalf, His Excellency
the Governor-General, with the advice of the Executive Council, doth hereby
amend and supplement the regulations referred to in the Schedule hereto
as shown therein.

SCHEDULE.

Regulations for the Government of the Royal Naval Reserves (New
Zealand Division), 1937, Part I.

Article 73: Cancel, and substitute :

  1. Obligatory Naval Training : Commander and Captain.—Courses
    in gunnery (21 days), torpedo (21 days), navigation (7 days), and in signals,
    submarine, and aircraft (14 days), within six years of promotion to Com-
    mander.
    These courses will, as far as the facilities or opportunities permit, be
    those laid down for the Royal Navy Senior Officers’ Technical Course.

NOTES.

(i) Requalifying courses in these subjects may be carried out at intervals
of not less than five years from the date of qualification or requalification
in each particular subject.
(ii) Commanders and Captains are not permitted to carry out any courses
or training other than the Senior Officers' Technical Course and the War
and Tactical Courses.

Article 75: Cancel.

Article 104, 2 (a): Insert:-

  1. (a) If, owing to active employment in his profession, or lack of adequate
    facilities for training, or for any other reason beyond his control an officer
    (other than a Captain or Commander of the Executive Branch) has been
    unable to perform his training or courses with regularity, he may, on com-
    pleting the training due within four years in the case of officers whose training
    is biennial, or within six years in the case of officers whose training period
    is triennial, from the termination of the year in which he last performed
    training or courses, in the discretion of the Naval Board, be allowed to
    draw his training fees due to date.
    If he fails to perform his training within such period, all training fees
    for that period, not already. earned, will be forfeited, and he will, if he
    eventually performs training or courses, become entitled only to draw his
    fees for the current calendar year.

Article 104, 2 (b) Insert:

  1. (b) Captains and Commanders of the Executive Branch will be entitled
    to training fees at the increased rate as from the date of promotion to the rank
    of Commander, and for five years subsequent to the 1st day of January
    following such promotion, irrespective of the completion of the courses to
    be carried out under Article 73. Those who have completed these courses
    will thereafter be entitled to training fees without further training. Those
    who fail to complete these courses will not be entitled to any further training
    fees. If, however, they eventually complete the courses, they will become
    entitled only to training fees for the current calendar year and for subsequent
    years.
