Member appointed to the Northbank Settlers’ Public Hall Board.

GALWAY, Governor-General.
ORDER IN COUNCIL.
At the Government House at Wellington, this 14th day of May, 1940.

Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by an Order in Council dated the ninth day of December, one thousand nine hundred and thirty-six, and published in the Gazette of the tenth day of that month, the control of the land described in the Schedule to that document, being a reserve for a site for a public hall, was vested in certain persons therein named, who were by the said Order in Council constituted a special Board, by the name of the “Northbank Settlers’ Public Hall Board,” in pursuance of section seventeen of the Public Reserves, Domains, and National Parks Act, 1928 :

And whereas it is desirable that Leonard Nesbit Bruning, of Te Rou, should be appointed a member of the said Board, in place of Ivan Dudley Mortimer, who has resigned :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers conferred on him by section seventeen of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby appoint the said

Leonard Nesbit Bruning

to be a member of the Northbank Settlers’ Public Hall Board constituted by the Order in Council dated the ninth day of December, one thousand nine hundred and thirty-six, hereinbefore referred to, in place of the said Ivan Dudley Mortimer, who has resigned.

Revoking a License held by Nicholas Benjamin Fryday, of Ngaere, authorizing the Use of Water for the Purpose of generating Electricity.

ORDER IN COUNCIL.
At the Government House at Wellington, this 14th day of May, 1940.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and with the consent of the licensee, doth hereby revoke the Order in Council dated the seventh day of August, one thousand nine hundred and twenty-two, and published in the New Zealand Gazette No. 61 of the tenth day of the same month, authorizing Nicholas Benjamin Fryday, of Ngaere, to use water for the purpose of generating electricity.

Varying the Determinations in respect of the Otorohanga Town Board’s Loan of £10,000.

ORDER IN COUNCIL.
At the Government House at Wellington, this 1st day of May, 1940.

Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by Order in Council made on the fifth day of July, one thousand nine hundred and thirty-eight, and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising in New Zealand by the Otorohanga Town Board (hereinafter called “the said local authority.”) of the sum of ten thousand pounds (£10,000) by a loan to be known as “Sewerage Loan, 1938” (hereinafter called “the said loan”):

And whereas the authority conferred by the said Order in Council has not yet been exercised and it is expedient to vary certain of the determinations aforesaid in respect of the said loan :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary certain of the determinations aforesaid in respect of the said loan by prescribing as follows :—

(1) In lieu of the term of thirty (30) years specified in clause one of the said Order in Council the term shall be twenty (20) years.

(2) In lieu of a rate of interest not exceeding three pounds ten shillings (£3 10s.) per centum per annum as specified in clause two of the said Order in Council the rate of interest that may be paid in respect of the said loan shall be such as shall not produce to the lender or lenders a rate exceeding four pounds five shillings (£4 5s.) per centum per annum.

Authorizing the Exchange of a Reserve in Borough of Marton, Wellington Land District, for other Land.

GALWAY, Governor-General.
ORDER IN COUNCIL.
At the Government House at Wellington, this 14th day of May, 1940.

Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS the land described in the First Schedule hereto is a reserve duly set apart for a site for a drill-shed. And whereas it is expedient that the said land should be exchanged for the land described in the Second Schedule hereto, which the Governor-General deems of equal value and more suitable for the purposes of the reserve:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section eight of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby declare that the land described in the First Schedule hereto may be exchanged for the land described in the Second Schedule hereto.

FIRST SCHEDULE.
WELLINGTON LAND DISTRICT.

Description of Reserve authorized to be exchanged.

ALL that area situated in the Borough of Marton, containing by admeasurement 24 perches, more or less, being part of Section 18, Rangitikei Agricultural Reserve, bounded: Commencing at a point distant 332 links from the southern boundary of the said Section 18, along the south-eastern side of Broadway towards the north-west by the said street 100 links; thence towards the north-east, south-east, and south-west by Lot 1A of the said Section 18, 150 links, 100 links, and 150 links respectively, to the point of commencement: be all the aforesaid linkages more or less. SECOND SCHEDULE.
WELLINGTON LAND DISTRICT.

Description of Land to be obtained in Exchange therefor.

ALL that area situated in the Borough of Marton, containing by admeasurement 32 perches, more or less, being Lot 45 on D.P. 14, being part of Section 17, Rangitikei Agricultural Reserve, and being all the land comprised in Certificates of Title, Vol. 12, folios 76 and 77, Wellington Registry.
