Declaring Waikanae Centennial Park, Gisborne, to be a Sanctuary under the Animals Protection and Game Act, 1921-22, East Coast Acclimatization District.

GALWAY, Governor-General.

IN pursuance of the powers conferred upon me by section six of the Animals Protection and Game Act, 1921-22 (hereinafter referred to as “the said Act”), I, George Vere Arundell, Viscount Galway, Governor-General of the Dominion of New Zealand, do hereby notify and declare the areas described in the Schedule hereto to be a sanctuary for the purposes of the said Act.

SCHEDULE.

ALL those areas in the Gisborne Land District comprising the Waikanae Centennial Park, and being Section part 1 D. Waihiharore, containing 4 acres 3 roods 34·5 perches; and Section part No. 2 Waihiharore, containing 6 acres 2 roods 30 perches.

As witness the hand of His Excellency the Governor-General, this 3rd day of April, 1940.

Notifying the proposed Exchange of Crown Land in the Auckland Land District for other Land.

GALWAY, Governor-General.

WHEREAS by section one hundred and sixty of the Land Act, 1924, it is enacted that it shall be lawful for the Governor-General, whenever he deems it expedient in the public interest, to grant in fee-simple any area of Crown land which is subject to the provisions of the Land Act, 1924, in exchange for the fee-simple of any other land, and on any such exchange to pay or receive any sum by way of equality of exchange:

And whereas, in the opinion of the Governor-General, it is expedient to exchange the Crown land described in the First Schedule hereto for the land of equal value described in the Second Schedule hereto, and the owners of the land described in the Second Schedule have agreed to such exchange:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in exercise of the aforesaid powers and authorities, doth hereby declare it is his intention to grant in fee-simple the area of Crown land described in the First Schedule hereto in exchange for the fee-simple of the land described in the Second Schedule.

FIRST SCHEDULE.

DESCRIPTION OF LAND AUTHORIZED TO BE EXCHANGED.

Auckland Land District.

Allotment 249, Matata Parish: Area, 4 acres 2 roods, more or less.

Allotment 246, Matata Parish: Area, 1 rood, more or less.

SECOND SCHEDULE.

DESCRIPTION OF LAND TO BE OBTAINED IN EXCHANGE THEREFOR.

Auckland Land District.

ALL that area in the Whakatane County containing by admeasurement 3 acres 2 roods 26 perches, more or less, being part Allotment 109, Matata Parish, bounded: Commencing at the north-western corner of Lot 1 on D.P. 22903, being part Allotment 109, Matata Parish, in a north-easterly direction along a right line bearing 20° 39′ distance 905·3 links; thence in a south-westerly direction along the original general western boundary of part Allotment 109, Matata Parish, contained in Certificate of Title, Volume 250, folio, 94, Auckland Registry, to the northern boundary of part Allotment 109, Matata Parish, on D.P. 10815; and thence along the northern boundary of part Allotment 109 on D.P. 10815, to the north-western corner of Lot 1 on D.P. 22903 aforesaid, the point of commencement; be all the aforesaid admeasurements a little more or less. As the same is more particularly delineated on the plan marked L and S. 22/2106b, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered purple. ALL that area in the Whakatane County containing by admeasurement 7 acres 1 rood 25 perches, more or less, being portion of Allotment 163, Matata Parish, bounded: Commencing at the northernmost corner of Allotment 246, Matata Parish, in north-easterly and north-westerly directions generally along the eastern boundary of part Allotment 163, Matata Parish, contained in Certificate of Title, Volume 632, folio 134, Auckland Registry, to and along the East Coast Main Trunk Railway to a point distant 103·5 links from the present left bank of the Tarawera River; thence in a southerly direction generally along right lines bearing 221° 43′ distance 313 links; bearing 198° 45′ distance 1493·7 links; bearing 194° 37′ 30″ distance 549·1 links; and bearing 184° 48′ 30″ 856·3 links to the northernmost corner of Allotment 246, the point of commencement.

Also all that area containing 6 acres 0 roods 28 perches, more or less, being portions of Allotments 163 and 21, Matata Parish, bounded: Commencing at the southernmost corner of Allotment 246, Matata Parish, in south-westerly and easterly directions generally along right lines bearing 191° 19′ distance 281·2 links; bearing 196° 45′ distance 299 links; bearing 205° 17′ distance 270·6 links; bearing 206° 7′ distance 413·1 links; bearing 208° 22′ distance 555·3 links; bearing 213° 31′ distance 252·4 links; bearing 195° 33′ distance 275·2 links; bearing 199° 49′ distance 502·5 links; bearing 77° 50′ 5″ distance 164·6 links; and bearing 77° 43′ distance 344·1 links; thence in a northerly direction along the old left bank of the Tarawera River to the southern boundary of Allotment 248, Matata Parish; thence along a right line bearing 258° 12′ 30″ distance 115 links, to the original south-eastern corner of Allotment 163, Matata Parish; and thence in a northerly direction generally along the eastern boundary of part Allotment 163, Matata Parish, contained in Certificate of Title, Volume 632, folio 134, Auckland Registry, to the southernmost corner of Allotment 246, Matata Parish, the point of commencement.

Be all the aforesaid admeasurements a little more or less; as the same are more particularly delineated on the plan marked L. and S. 22/2106c, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered yellow. (Auckland plan 30244.)

Notice of Intention to issue an Order in Council changing the Reservation over Part of the Hector Domain, Nelson Land District.

GALWAY, Governor-General.

WHEREAS by section forty-one of the Public Reserves, Domains, and National Parks Act, 1928 (hereinafter referred to as “the said Act”), it is provided that the Governor-General may from time to time by Order in Council, but subject to compliance with the requirements of subsection two of section seven of the said Act, declare that the land comprised in a public domain or part thereof shall cease to be subject to Part II of the said Act; and, further, may declare either that such land shall be a public reserve for the purposes of Part II of the said Act, or Crown land available for disposal by way of sale for cash under the Land Act, 1924:

And whereas the land described in the Schedule hereto is part of the Hector Domain but is not required for domain purposes, and it is expedient to change the purpose of the reservation over the said land to an addition to a school-site (Hector):

Now, therefore, I, George Vere Arundell, Viscount Galway, Governor-General of the Dominion of New Zealand, do hereby give notice pursuant to subsection two of section seven of the said Act that it is my intention to issue an Order in Council under the provisions of section forty-one of the said Act declaring that the part of the Hector Domain described in the Schedule hereto shall cease to be subject to Part II of the said Act, and shall be deemed to be a reserve for an addition to a school-site (Hector).

SCHEDULE.

NELSON LAND DISTRICT.—PART OF HECTOR DOMAIN.

ALL that area containing by admeasurement 3 roods 15 perches, more or less, being part Section 79A and part Section 165, Town of Hector, situated in Block I, Ngakawau Survey District, bounded: On the north-east by Greenfield Street, 118·6 and 264·3 links; on the south-west by Section 167, 136·4 links; on the south-east by Section 167, 45·5 links; on the south-west by part Section 165, 90·5 links; and on the north-west by other part Section 165, 431·6 links. As the same is more particularly delineated on the plan marked L. and S. 1/703/C, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon in outline bordered red.

As witness the hand of His Excellency the Governor-General, this 5th day of April, 1940.
