The South-western Side of Portion of Shandon Road, in the
County of Peninsula, exempted from the Provisions of
Section 128 of the Public Works Act, 1928, subject to a
Condition us to the Building-line.

GALWAY, Governor-General.
ORDER IN COUNCIL.
At the Government House at Wellington, this 27th day of
November, 1940.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the
Public Works Act, 1928, and of every other power in
anywise enabling him in this behalf, His Excellency the
Governor-General of the Dominion of New Zealand, acting
by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby approve of the following
resolution passed by the Peninsula County Council on the
seventeenth day of October, one thousand nine hundred
and forty, in so far as it affects the side and portion of road
described in the Schedule hereto, viz. :-
"That the Peninsula County Council, being the local
authority having control of the roads in the County of
Peninsula, by resolution declares that the provisions of
section one hundred and twenty-eight of the Public
Works Act, 1928, shall not apply to that portion of
Shandon Road abutting on Lots 26 and 27, Block VII,
Township of Waverley ";
subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the south-
western side of the portion of Shandon Road (described
in the Schedule hereto) within a distance of thirty-three feet
from the centre-line of the said portion of road.
SCHEDULE.
THE south-western side of all that portion of road, situated
in the Otago Land District, Peninsula County, known as
Shandon Road, fronting Lots 26 and 27, Block VII, D.P. 289,
Township of Waverley. As the same is more particularly
delineated on the plan marked P.W.D. 109256, deposited
in the office of the Minister of Public Works at Wellington,
and thereon coloured red.

The Western Side of Portion of Henwood Road, in the County
of Taranaki, exempted from the Provisions of Section 128 of
the Public Works Act, 1928, subject to a Condition as to
the Building-line.

Henwood Road fronting part Section 4, Hua District,

the western side of the portion of Henwood Road (described
in the Schedule hereto) within a distance of thirty-three
feet from the centre-line of the said portion of road.

SCHEDULE.
The western side of all that portion of road situated in the
Taranaki Land District, County of Taranaki, known as
Henwood Road, fronting parts Section 4 of the Hua District,
Block II, Paritutu Survey District. As the same is more
particularly delineated on the plan marked P.W.D. 109255,
deposited in the office of the Minister of Public Works at
Wellington, and thereon coloured yellow.

Declaring Whangarei Harbour to be a Sanctuary under the
Animals Protection and Game Act, 1921-22.-Whangarei
Acclimatization District.

GALWAY, Governor-General.

IN pursuance of the powers conferred upon me by section
six of the Animals Protection and Game Act, 1921-22
(hereinafter referred to as "the said Act"), I, George Vere
Arundell, Viscount Galway, Governor-General of the
Dominion of New Zealand, do hereby notify and declare the
areas described in the Schedule hereto to be a sanctuary for
the purposes of the said Act.

SCHEDULE.
ALL that area bounded by a line commencing at the southern
extremity of Busby Head at the line of ordinary high-water
mark and proceeding thence north-westerly generally along
the line of ordinary high-water mark in Whangarei Harbour
and Whangarei River as far as the northern boundary-line
of Parahaki No. 1 Block, numbered 436 ; thence crossing
the said Whangarei River and following the right bank of
the said river along the ordinary high-water mark thereof;
thence generally southerly and easterly along the ordinary
high-water mark of the Whangarei Harbour as far as a point
where the production of the eastern side of the road running
between Blocks IV and VIII and Blocks II, III, and VII of
the Town of Marsden intersects the line of high-water mark;
and thence along a straight line to the starting point at
Busby Head (as the same is delineated upon the plan marked
M.D. 1787, and deposited in the office of the Marine Department at Wellington) : including within such area all bays,
tidal streams, rivers, and inlets running or flowing into the
said harbour up to the ordinary high-water mark.
As witness the hand of His Excellency the Governor-General, this 22nd day of November, 1940.

IN pursuance of the powers conferred upon me by section
six of the Animals Protection and Game Act, 1921-22
(hereinafter referred to as "the said Act"), I, George Vere Arundell, Viscount Galway, Governor-General of the
Dominion of New Zealand, do hereby notify and declare the
area described in the Schedule herefo to be a sanctuary for
the purposes of the said Act.

SCHEDULE.
ALL that area in the Gisborne Land District containing
62 acres 2 roods 18 perches, more or less, and being Section 4,
Block VIII, Opotiki Survey District. (Gisborne plan 4078, blue.)

As witness the hand of His Excellency the Governor-General, this 21st day of November, 1940.
