The Napier Milk Delivery Scheme 1940, amended.
Office of the Oil Fuel Controller,
Transport Department, Wellington.
WHEREAS by a notice (hereinafter referred to as "the said notice") published in the Gazette on the 5th day of September, 1940, the Minister of Supply, pursuant to Regulation 3 of the Delivery Emergency Regulations 1940, approved the Napier Milk Delivery Scheme 1940 (hereinafter referred to as "the scheme"), in respect of the Borough of Napier: And whereas it is desired to extend the operation of the scheme to certain portions of the Hawke's Bay County, and the Minister of Supply is satisfied that all the vendors of milk (otherwise than by sale over the counter) in those portions of the Hawke's Bay County have become parties to the scheme or have been given an opportunity of becoming parties thereto: Now, therefore, the Minister of Supply, pursuant to the said Regulation 3, doth hereby amend the said notice as follows:-
(a) By omitting clause 1 of the Schedule to the said notice, and substituting the following clause:-
"1. For the purposes of the scheme-
"'The commodity' means milk, and includes cream;
"'The district' means the Borough of Napier and those portions of the Hawke's Bay County delineated on the plan and the amending plan hereinafter referred to;
"'The plan' means the plan of portion of the district deposited for the purposes of the scheme in the Head Office of the Transport Department at Wellington under No. 3274;
"'The amending plan' means the plan of the remaining portion of the district (not included in the plan numbered 3274) deposited for the purposes of the scheme in the Head Office of the Transport Department at Wellington under No. 3274a."
(b) By omitting the footnote, referring to A. A. Anderson, of Bay View, appended to the said notice:
(c) By adding to the Table (contained in clause 3 of the Schedule to the said notice) describing the persons entitled to deliver the commodity in the district and the extent to which they are so entitled, the following:-

Hawera Milk Delivery Scheme 1940, approved.
Office of the Oil Fuel Controller,
Transport Department, Wellington.
PURSUANT to Regulation 3 of the Delivery Emergency Regulations 1940, the Minister of Supply, being satisfied that all the vendors of milk (otherwise than by sale over the counter) in the district specified in the scheme referred to in the Schedule hereto are parties to the scheme or have been given an opportunity of becoming parties thereto, doth hereby approve the said scheme.
