Fixing Sittings of the Court of Appeal.
GALWAY, Governor-General.
ORDER IN COUNCIL.
At the Government House at Wellington, this 24th day of October, 1940.
Present:
His Excellency the Governor-General in Council.
WHEREAS by the Judicature Amendment Act, 1913, it is enacted that the Court of Appeal shall hold its sittings at such times and places as are from time to time appointed by the Governor-General in Council and notified in the Gazette twenty-one days at least before the times so fixed respectively, and that such appointment shall determine the Division by which such sittings shall be held:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint and declare that sittings of the Court of Appeal of New Zealand shall be held within the Supreme Court House, in the City of Wellington, upon the following days, at eleven o'clock in the forenoon, and doth hereby determine that such sittings shall be held by the respective Divisions of the said Court as are shown hereunder:-
Monday, the tenth day of March, one thousand nine hundred and forty-one: By the Second Division of the said Court.
Monday, the ninth day of June, one thousand nine hundred and forty-one: By the First Division of the said Court.
Monday, the eighth day of September, one thousand nine hundred and forty-one: By the Second Division of the said Court.

Authorizing the Laying-off of a Street (Wordsworth Street Extension) in the City of Christchurch, of a Width less than 66 ft., but not less than 50 ft. 6 in.

His Excellency the Governor-General in Council.
IN pursuance and exercise of the powers vested in him by the Municipal Corporations Act, 1933, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the Christchurch City Council to permit the laying-off of the street described in the Schedule hereto of a width less than sixty-six feet but not less than fifty feet six inches.
SCHEDULE.
THAT proposed street in the Canterbury Land District, City of Christchurch, containing by admeasurement 1 rood 25 perches, more or less, being Lot 1 and part Lot 2, Deposited Plan 2566, and Lot 82, Deposited Plan 2, all being parts Rural Section 79. As the same is more particularly delineated on the plan marked P.W.D. 108399, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The South-eastern Side of Portion of Road, in the County of Takaka, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this 24th day of October, 1940.
Present:
His Excellency the Governor-General in Council.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Takaka County Council on the eleventh day of June, one thousand nine hundred and forty (in so far as it affects the side and portion of road described in the Schedule hereto), viz.:-
"That the Takaka County Council, being the local authority having control of the roads in the County of Takaka, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that adjoining portion of road fronting the north-western boundary of part Section 64, Square 13, Block III, Waitapu Survey District, Takaka District, and Section l of 64, Block V, Waitapu Survey District";
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of road (described in the Schedule hereto) within a distance of thirty-five feet from the centre-line of the said portion of road.
SCHEDULE.
THE south-eastern side of all that portion of road, situated in the Nelson Land District, County of Takaka, fronting part Section l of 64, Takaka. Block V, Waitapu Survey District, and part Section 64, Square 13, Block III, Waitapu Survey District. As the same is more particularly delineated on the plan marked P.W.D. 108906, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Nelson City Council on the third day of October, one thousand nine hundred and forty, viz.:-
"That the Nelson City Council, being the local authority having control of the streets in the City of Nelson, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the south-eastern side of the portion of Emano Street fronting part Sections 83l and 832, City of Nelson, as shown on the plan attached to this resolution in the Council's minute-book";
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Emano Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.
SCHEDULE.

As the same is more particularly delineated on the plan marked P.W.D. 108163, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.
