CONTROL OF MEDICAL SUPPLIES.

  1. No wholesaler shall sell, deliver, or otherwise dispose of, or be
    concerned in the sale, delivery, or other disposal of, any medical
    supplies otherwise than in pursuance of an exemption or permit granted
    by the Controller under the principal regulations.

  2. The last preceding clause shall apply as well to a sale, delivery,
    or disposal pursuant to any contract made before the coming into force
    of these regulations as to a sale, delivery, or disposal pursuant to a
    contract hereafter made.

  3. It shall be a defence to any wholesaler charged with an offence
    against clause 3 of these regulations if he proves in respect of the
    sale, delivery, or disposal in question—

(a) That it was effected on grounds of urgency;

(b) That the delay in carrying out the transaction entailed in
seeking a permit would, upon the facts known to the whole-
saler at the time, have been prejudicial to the public
interest;

(c) That the quantity of medical supplies the subject of the trans-
action was not greater than was necessary to meet the
immediate and reasonable requirements of the person to
whom they were sold, delivered, or disposed of; and

(d) That within twenty-four hours of the transaction full particulars
thereof and the reasons for carrying it out were supplied in
writing by the wholesaler to the Controller.

  1. (1) The Controller may from time to time regulate, restrict, and
    control the use, sale, supply, distribution, and disposal of medical
    supplies. The powers conferred by this regulation may be exercised
    either generally or in respect of any specified area, industry or class of
    industries, factory or class of factories, supplies or class of supplies, or
    person or class of persons.

(2) Without limiting the general powers conferred on the Controller
by this regulation, it is hereby declared that they shall be deemed to
include power to do all or any of the following things:

(a) To require or direct owners of medical supplies to furnish such
information and particulars in relation thereto, at such times
and in such form and manner as the Controller thinks fit :

(b) To require or direct owners of medical supplies to supply or
transfer the whole or any part thereof to His Majesty the
King or to any other person, in such quantities, at such
places, at such times or intervals, in such order of urgency,
and generally in such manner as the Controller thinks fit :

(c) To require or direct owners of medical supplies not to use,
dispose of, part with the possession or control of, or other-
wise deal with medical supplies except with the precedent
consent of the Controller or in accordance with his directions :

(d) To require or direct persons obtaining medical supplies from
wholesalers to specify the source of their supply; and to
require or direct such persons not to order or obtain medical
supplies except from such sources as the Controller thinks
fit.

  1. Every wholesaler shall at all times permit the Controller and any
    person authorized by him in that behalf to inspect his stocks of medical
    supplies and all records of the receipt, supply, and distribution thereof.
