Vesting the Control of a Scenic Reserve in the Matiere Scenic Board.

GALWAY, Governor-General.

IN pursuance and exercise of the powers and authorities conferred upon him by section thirteen of the Scenery Preservation Act, 1908, His Excellency the Governor-General of the Dominion of New Zealand doth hereby vest the control of the reserve described in the Schedule hereto (being land reserved under the said Act), for the period of five years from the date hereof (unless previously altered or revoked under the said Act), in the undermentioned persons, namely,—

Robert William Dench,
John Gray,
Maxwell McEwan Anderson,
Frederic John Bishop,
Frank Pleasants,
Jack Rowland Turner, and
Noel Eugene Mangan,

who are hereby constituted for that purpose a special Board by the name of the Matiere Scenic Board (herein referred to as “the Board”), in trust, for the preservation of scenery, and with the powers and subject to the conditions hereinafter contained, that is to say,—

  1. The first meeting of the Board shall be held on Wednesday, the fifteenth day of February, one thousand nine hundred and thirty-nine, at eight o’clock p.m., in the Public Hall, Matiere.

  2. The members of the Board shall at their first meeting, and thereafter at the annual meeting hereinafter mentioned, elect one of themselves to be chairman, who may join in the discussion, and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor.

  3. Special meetings may be convened by the Chairman, provided that two days’ notice of such meeting is given to each member, specifying the business to be transacted at such special meeting; and no other business than that so specified shall be transacted at such meeting.

  4. Any four members of the Board shall form a quorum. Any meeting may be adjourned from time to time.

  5. All questions shall be determined by the majority of votes of the members of the Board present at the meeting.

  6. If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose one of their number to be chairman for such meeting.

  7. If by resignation, death, incapacity, or otherwise, the seat of any member shall be or become vacant, or if any member absents himself, without reasonable cause, from three consecutive meetings of the Board, the Governor-General shall have power to appoint any other person to be a member of the Board in his stead.

  8. The Board shall prepare and submit at an annual meeting to be held in the month of April in each year a report of the proceedings of the Board for the previous year ending on the thirty-first day of March, together with a statement of the receipts and expenditure of the Board for such year. A copy of every such report and statement, certified by the Chairman to be correct, shall be sent to the Minister in Charge of Scenery Preservation as soon as possible after each annual meeting.

  9. The Board shall control the said reserve in accordance with the provisions of the said Act and of the regulations made thereunder.

SCHEDULE.

MATIERE SCENIC RESERVE.—TARANAKI LAND DISTRICT.

All that area containing by admeasurement 2 acres 1 rood 8 perches, more or less, being part Section 28, Block XV, Aria Survey District. Bounded towards the north-east by the Ohura-Mokau Road, 1,340 links, and towards the south-west by a road reserve, 1,450 links: be all the aforesaid linkages more or less. As the same is delineated on the plan marked L. and S. 4/444a, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

Notifying the proposed Exchange of Crown Land in the Gisborne Land District for other Land.

GALWAY, Governor-General.

WHEREAS by section one hundred and sixty of the Land Act, 1924, it is enacted that it shall be lawful for the Governor-General, whenever he deems it expedient in the public interest, to grant in fee-simple any area of Crown land which is subject to the provisions of the Land Act, 1924, in exchange for the fee-simple of any other land, and on any such exchange to pay or receive any sum by way of equality of exchange:

And whereas in the opinion of the Governor-General it is expedient to exchange the Crown land described in the First Schedule hereto for the land described in the Second Schedule hereto, and the owner of the land described in the Second Schedule has agreed to such exchange:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in exercise of the aforesaid powers and authorities, doth hereby declare it is his intention to grant in fee-simple the area of Crown land described in the First Schedule hereto in exchange for the fee-simple of the land described in the Second Schedule.

FIRST SCHEDULE.

DESCRIPTION OF LAND AUTHORIZED TO BE EXCHANGED.

Gisborne Land District.

All that area in the Cook County, containing by admeasurement 3 acres 1 rood 7-1 perches, more or less, being Lot 4 on D.P. 3428, deposited in the office of the District Land Registrar at Gisborne, and being part of Section 4, Block XI, Waimata Survey District. As the same is more particularly delineated on the plan marked L. and S. XI/2/154a, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red. (Gisborne Plan D.P. 3428.).

SECOND SCHEDULE.

DESCRIPTION OF LAND TO BE OBTAINED IN EXCHANGE THEREFOR.

Gisborne Land District.

All that area in the Cook County, containing by admeasurement 3 acres 1 rood 7 perches, more or less, being Lots 1, 2, and 3 on D.P. 3428, deposited in the office of the District Land Registrar at Gisborne, and being part Subdivision H, Whatapoko No. 9 Block, and part Section 5, Block XI, Waimata Survey District. As the same is more particularly delineated on the plan marked L. and S. XI/2/154a, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged green. (Gisborne Plan D.P. 3428.).

As witness the hand of His Excellency the Governor-General, this 10th day of February, 1939.

Revoking in Part Warrants temporarily and permanently reserving certain Lands for various Purposes.

GALWAY, Governor-General.

IN pursuance and exercise of the powers conferred upon me by section five of the Land Act, 1924, and of every other power enabling me in that behalf, I, George Vere Arundell, Viscount Galway, Governor-General of the Dominion of New Zealand, do hereby revoke in so far as they relate to the land described in the Schedule hereto a temporary Warrant dated the sixth day of September, one thousand nine hundred and one, and published in the New Zealand Gazette of the twelfth day of that month, and a permanent Warrant dated the nineteenth day of October, one thousand nine hundred and one, and published in the New Zealand Gazette of the twenty-fourth day of that month, reserving certain lands for various purposes.

SCHEDULE.

NORTH AUCKLAND LAND DISTRICT.

ALLOTMENT 82A, Mahurangi Parish: Area, 27 acres, more or less.

As witness the hand of His Excellency the Governor-General, this 14th day of February, 1939.
