Validating Proceedings in connection with the Proposed Loan of £1,200 by the Rangiora Borough Council.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 30th day of January, 1939.
Present:
THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.
WHEREAS the Rangiora Borough Council lately proceeded to raise a loan of one thousand two hundred pounds (£1,200) under the provisions of the Local Bodies' Loans Act, 1926, to be known as "Lyndhurst Reserve Loan, 1937," for the purpose of erecting a new house on the Council's Reserve at Lyndhurst :
And whereas the proceedings in connection with the said loan were irregular and defective in that the confirming meeting as required by subsection (b) of section sixty-two of the Municipal Corporations Act, 1933, was held sooner than the twenty-eighth day after the day of the special meeting held pursuant to subsection (a) of the said section :
And whereas it appears that the ratepayers of the district have not been misled by any such irregularity as aforesaid and it is expedient to validate the same :
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred on him by section one hundred and twenty-two of the Local Bodies' Loans Act, 1926, and section three hundred and eighty-seven of the Municipal Corporations Act, 1933, and of all other powers and authorities enabling him in this behalf, doth hereby order and declare that the proceedings taken in connection with the raising of the said loan shall be valid to all intents and purposes as though the confirming meeting had been held not sooner than the twenty-eighth day after the day of such special meeting :
And that the validity of the proceedings in connection with the said loan or the validity of the security for the said loan shall not be questioned on the ground of such irregularity or defect.

WHEREAS the Otago Central Electric-power Board lately proceeded to raise loans of ten thousand pounds (£10,000) and five thousand pounds (£5,000) (hereinafter referred to as "the said respective loans") under the provisions of the Local Bodies' Loans Act, 1926 (hereinafter referred to as "the said Act") for the purpose of erecting a transmission line to and reticulating the Poolburn portion of the Power Board's district and making advances to consumers for the purposes set out in section one hundred and eighteen of the Electric-power Boards Act, 1925, respectively :
And whereas the proceedings in connection with the said respective loans were irregular or defective in that in each case the poll of ratepayers was taken less than one week after the day of the last publication of the notice mentioned in section ten of the said Act :
And whereas it appears that the ratepayers of the district have not been misled by such irregularities or defects as aforesaid and it is expedient to validate the same :
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred on him by section one hundred and twenty-two of the said Act, and of all other powers and authorities enabling him in this behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the proceedings in connection with the said respective loans shall be valid to all intents and purposes as though in each case the poll of the ratepayers had been taken not less than one week after the day of the last publication of the notice mentioned in section ten of the said Act, and that the validity of the proceedings in connection with the said respective loans or the validity of the security for the said respective loans shall not be called in question by reason only of the irregularities or defects aforesaid.

Directing Sale of Railway Land at Katikati under the Public Works, Act, 1928.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 30th day of January, 1939.

THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.
WHEREAS by the thirty-fifth section of the Public Works Act, 1928 (hereinafter termed "the said Act"), it is enacted that if it is found that any land held, taken, purchased, or acquired at any time under this or any other Act or Provincial Ordinance, or otherwise howsoever, for any public work is not required for such public work the Governor-General may, by Order in Council publicly notified and gazetted, cause the same to be sold under the conditions set forth in the said Act :
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon him by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and direct the sale of the said land described in the Schedule hereto.
