Portions of Farley and Brighton Streets, in the City of Dunedin, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 30th day of January, 1939.

Present:

THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the fourteenth day of September, one thousand nine hundred and thirty-six, viz. :—

“ That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the undermentioned portions of streets, viz. :—

(a) The south-eastern side of portion of Farley Street abutting on part Allotment 3 on L.T.P. 375, being parts of Sections 14 and 16, Block III, Upper Kaikorai District, and

(b) The south-western side of portion of Brighton Street abutting on part Allotment 3 on L.T.P. 375, being parts of Sections 14 and 16, Block III, Upper Kaikorai District ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Farley Street or the south-western side of the portion of Brighton Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-lines of the said portions of streets.

SCHEDULE.

THE south-eastern side of all that portion of street, situated in the Otago Land District, City of Dunedin, known as Farley Street, fronting part Lot 3, D.P. 375, being part Sections 14 and 16, Block III, Upper Kaikorai District.

Also the south-western side of all that portion of street in the said land district and city known as Brighton Street, fronting part Lot 3, D.P. 375, being part Sections 14 and 16, Block III, Upper Kaikorai District.

As the same are more particularly delineated on the plan marked P.W.D. 101370, deposited in the office of the Minister of Public Works at Wellington, and thereon edged red.

Portions of Roads in the County of Taranaki, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

At the Government Buildings at Wellington, this 30th day of January, 1939.

Present:

THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Taranaki County Council on the fifth day of September, one thousand nine hundred and thirty-eight, viz. :—

“ That the Taranaki County Council, being the local authority having control of the roads in the County of Taranaki, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of the Henwood Road fronting Sections 13, 13A, and part 14, Hua District, Block VI, Paritutu Survey District, extending from the north-east corner of the said Section 13 to the southern-most corner of the said part Section 14, and also that portion of the unnamed road fronting Sections 76 and 77, Block VI, Paritutu Survey District, extending from the north-west corner of the said Section 76 to the south-west corner of the said Section 77, Block VI, Paritutu Survey District, as more particularly delineated on plan prepared by Messrs. Sladden and Palmer, dated June, 1926 ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side generally of the portion of Henwood Road or the eastern side of the portion of unnamed road (described in the Schedule hereto), within a distance of thirty-three feet from the centre-lines of the said portions of roads.

SCHEDULE.

THE western side generally of all that portion of road situated in the Taranaki Land District, County of Taranaki, known as Henwood Road, fronting Sections 13 and 13A and part Section 14, Hua District, Block VI, Paritutu Survey District.

Also the eastern side of all that portion of an unnamed road situated in the said land district and county, fronting Sections 76 and 77, Block VI, Paritutu Survey District.

As the said portions of roads are more particularly delineated on the plan marked P.W.D. 100904, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

“ That the Devonport Borough Council, being the local authority having control of the streets in the Borough of Devonport, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the western side of portion of Anne Street abutting on Lots 1 and 2 of Allotment 22A, Section 2, Parish of Takapuna ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side of the portion of Anne Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE western side of all that portion of street, situated in the North Auckland Land District, Borough of Devonport, known as Anne Street, fronting part Allotment 22A, Section 2, Parish of Takapuna. As the same is more particularly delineated on the plan marked P.W.D. 100964, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.
