Portion of Moa Place, in the City of Christchurch, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 2nd day of June, 1939.

Present:

THE HON. P. FRASER PRESIDING IN COUNCIL.

In pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anyway enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Christchurch City Council on the twenty-first day of February, one thousand nine hundred and thirty-eight, viz:-

"The Christchurch City Council, being the local authority having control of the streets in the City of Christchurch, hereby by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of the northern side of Moa Place adjoining the land comprised in Lots 3 and 4 Deposit Plan 7092";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the northern side of the portion of Moa Place (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

The northern side of all that portion of street, situated in the Canterbury Land District, City of Christchurch, known as Moa Place, fronting Lots 3 and 4, D.P. 7092, being part of Town Reserve 160. As the same is more particularly delineated on the plan marked P.W.D. 102835, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Portions of Gill Street and Watson Street, in the Borough of New Plymouth, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

At the Government Buildings at Wellington, this 2nd day of June, 1939.

Present:

THE HON. P. FRASER PRESIDING IN COUNCIL.

In pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anyway enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the New Plymouth Borough Council on the twentieth day of March, one thousand nine hundred and thirty-nine, viz.:-

"That the New Plymouth Borough Council, being the local authority having control of the streets hereinafter mentioned, hereby resolves and declares that the provisions of section one hundred and twenty-eight, subsection one, of the Public Works Act, 1928, shall not apply-

"(a) To that portion of the southern side of Gill Street to which Section 2008, New Plymouth, has frontage; nor

"(b) To that portion of the western side of Watson Street to which Section 2008, New Plymouth, has frontage";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side of the portion of Gill Street or the western side of the portion of Watson Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of streets.

SCHEDULE.

The southern side of all that portion of street, situated in the Taranaki Land District, Borough of New Plymouth, known as Gill Street, fronting Section 2008, Town of New Plymouth.

Also the western side of all that portion of street situated in the said land district and borough, known as Watson Street, fronting Section 2008, Town of New Plymouth.

As the same are more particularly delineated on the plan marked P.W.D. 102886, deposited in the office of the Minister of Public Works at Wellington, and thereon edged yellow.

Portions of Argyle Street, and Glen Avenue, in the City of Dunedin, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

At the Government Buildings at Wellington, this 2nd day of June, 1939.

Present:

THE HON. P. FRASER PRESIDING IN COUNCIL.

"That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the undermentioned portions of streets viz. :-

"(a) The north-eastern side of portion of Argyle Street abutting on Lot 1, D.P. 3332, of part Section 74, Block VI, Town District; and

"(b) The north-western side of portion of Glen Avenue abutting on Lot 1, D.P. 3332, of part Section 74, Block VI, Town District";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-eastern side of the portion of Argyle Street, or the north-western side of the portion of Glen Avenue (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of streets.

SCHEDULE.

The north-eastern side of all that portion of street situated in the Otago Land District, City of Dunedin, known as Argyle Street, fronting Lot 1, D.P. 3332, being part Section 74, Block VI, Town District.

Also the north-western side of all that portion of street situated in the said land district and city known as Glen Avenue, fronting Lot 1, D.P. 3332, being part Section 74, Block VI, Town District.

As the same are more particularly delineated on the plan marked P.W.D. 102786, deposited in the office of the Minister of Public Works at Wellington, and thereon edged red.
