Recreation Reserve in North Auckland Land District brought under Part II of the Public Reserves, Domains, and National Parks Act, 1928.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 2nd day of June, 1939.
Present:
THE HON. P. FRASER PRESIDING IN COUNCIL.
BY virtue of the powers and authorities vested in me by the thirty-fourth section of the Public Reserves, Domains, and National Parks Act, 1928, I, George Vere Arundell, Viscount Galway, Governor-General of the Dominion of New Zealand, by and with the advice and consent of the Executive Council of the said Dominion, do hereby order and declare that the reserve for recreation in the North Auckland Land District described in the Schedule hereto shall be and the same is hereby brought under the operation of and declared to be subject to the provisions of Part II of the said Act, and such reserve shall hereafter form part of the Kaitaia Domain, and be managed, administered, and dealt with as a public domain by the Kaitaia Domain Board.
SCHEDULE.
NORTH AUCKLAND LAND DISTRICT.
ALL that area in the Kaitaia Town District, containing by admeasurement 2 acres 3 roods 19.9 perches, more or less, being Lot 44 on a plan numbered 14963, deposited in the office of the District Land Registrar at Auckland, and being part of Section 26, Block V, Takahue Survey District. As the same is more particularly delineated on the plan marked L. and S. 1/475D, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

Authorizing the Laying-off of Streets in the Borough of Napier of Widths less than 66 ft., but not less than 50 ft. and 60 ft., respectively, subject to a Condition as to the Building line.

At the Government Buildings at Wellington, this 2nd day of June, 1939.

THE HON. P. FRASER PRESIDING IN COUNCIL.
IN pursuance and exercise of the powers vested in him by the Public Works Act, 1928, and the Municipal Corporations Act, 1933, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the Napier Borough Council to permit the laying-off of the proposed streets described in the First Schedule hereto of widths less than sixty-six feet, but not less than fifty feet, and the proposed street described in the Second Schedule hereto of a width less than sixty-six feet, but not less than sixty feet, subject to the condition that no building or part of a building shall at any time be erected on the land fronting the said streets within a distance of twenty-five feet from the boundaries of such streets; provided, however, that this condition shall not apply to the land marked "Service Lane" and "Commercial District" and bordered red on the plan marked P.W.D. 102803 mentioned in the Schedules hereto.
FIRST SCHEDULE.
FIRST, those proposed streets in the Hawke's Bay Land District, Borough of Napier, containing by admeasurement 2 acres 19.5 perches, more or less, and being portion of Lot 168, L.T.P. 6598, being part Te Whare-o-Maraenui Block, and part Section 10R, Block IV, Heretaunga Survey District; coloured red.
Secondly, that proposed street in the said land district and borough, containing by admeasurement 2 roods 12.3 perches, more or less, and being portion of Lot 169, L.T.P. 6598, being part Te Whare-o-Maraenui Block; coloured yellow.
As the same are delineated on the plan marked P.W.D. 102803, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured as above mentioned.
SECOND SCHEDULE.
THAT proposed street in the Hawkes Bay Land District, Borough of Napier, containing by admeasurement 4 acres 1 rood 10.4 perches, more or less, and being part Lot 169 and Lots 171, 206, 208, and 232, L.T.P. 6598, being part Te Whare-o-Maraenui Block and part Ahuriri Lagoon Reserve. As the same is delineated on the plan marked P.W.D. 102803, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured blue and red.
