Authorizing the Borrowing by the Nelson City Council by Way
of Hypothecation of Debentures issued in respect of a Loan
of £87,200.

ORDER IN COUNCIL.
At the Government House at Wellington, this 19th day
of April, 1939.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS by Order in Council made on the tenth day
of January, one thousand nine hundred and thirty-
nine, consent was given to the raising in New Zealand by the
Nelson City Council (hereinafter called “the said local
authority”) of the sum of eighty-seven thousand two hundred
pounds (£87,200) by a loan to be known as “Electric Light
and Antecedent Liability Renewal Loan, 1939” (hereinafter
called “the said loan”) such consent being given subject to the
determinations as to borrowing and repayment therein set
out, including, inter alia, the provision that the rate of interest
that might be paid in respect of the said loan or any part
thereof should be such as should not produce to the lender
or lenders a rate or rates exceeding three pounds ten shillings
(£3 10s.) per centum per annum;
And whereas the said local authority pending the raising
of the said loan in accordance with the said determinations,
is desirous of borrowing the said amount or part thereof by
hypothecation or mortgage pursuant to section thirty-four of
the Local Bodies’ Loans Act, 1926, of the debentures autho-
rized to be issued in respect of the said loan:
Now, therefore, His Excellency the Governor-General of
the Dominion of New Zealand, acting by and with the advice
and consent of the Executive Council of the said Dominion,
and in pursuance and exercise of the powers and authorities
conferred on him by section seven of the Local Authorities
Interest Reduction and Loans Conversion Act, 1932-33, and
by section eight of the Local Authorities Interest Reduction
and Loans Conversion Amendment Act, 1933, and of all other
powers and authorities enabling him in this behalf, doth
hereby consent to the said local authority pending the raising
of the said loan in accordance with the said determinations
borrowing the said sum of eighty-seven thousand two hundred
pounds (£87,200) or any part thereof by the hypothecation
or mortgage of the said debentures at a rate of interest not
exceeding four pounds ten shillings (£4 10s.) per centum per
annum, and hereby prescribes that the said local authority shall,
before the said sum of eighty-seven thousand two hundred
pounds (£87,200) or any portion thereof is borrowed by way
of hypothecation pursuant to the authority of this Order in
Council establish a sinking fund in accordance with clause
three of the aforesaid Order in Council of the tenth day of
January, one thousand nine hundred and thirty-nine, and in
all respects as if such borrowing of the said sum or part thereof
by way of hypothecation were the raising of a loan within the
meaning of that clause.

Revoking the Declaration of Main Highways and declaring
Public Highways to be Main Highways.

ORDER IN COUNCIL.
At the Government House at Wellington, this 19th day of
April, 1939.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers and authorities
vested in him by section three of the Main Highways
Act, 1922, and of all other powers in anywise enabling him
in this behalf, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice
and consent of the Executive Council of the said Dominion,
doth hereby declare that as from the first day of April, one
thousand nine hundred and thirty-nine, the portion of main
highway described in the First Schedule hereto shall cease
to be a main highway, and that as from the date of publication
of this Order in Council in the Gazette, the portions of main
highways described in the Second Schedule hereto shall cease
to be main highways, and doth further declare that on and
after the date of publication of this Order in Council in the
Gazette, the public roads described in the Third Schedule
hereto shall be main highways within and for the purposes of
the Main Highways Act, 1922.
FIRST SCHEDULE.
HIGHWAY DISTRICT No. 2.
Great South Road.—All that portion of main highway in
the Franklin County, commencing at a point approximately 5 chains
north of the south-eastern corner of Lot 115, Suburban Section 1, Suburbs
of Pokeno, and proceeding thence generally in a south-easterly direction
and terminating at a point approximately 2 chains south of
the western corner of Lot 116, Suburban Section 1, Suburbs
of Pokeno, being a distance of 4 miles 42 chains, more or less ;
as the same is more particularly delineated on plan
P.W.D. 102469, deposited in the office of the Main Highways
Board at Wellington, and thereon coloured green.
Also all that portion of main highway in the Franklin
County, commencing at a point approximately 5 chains
north of the south-eastern corner of Lot 115, Suburban Section 1, Suburbs
of Pokeno, and proceeding thence generally
in a south-easterly direction and terminating opposite the
southern corner of Lot 19, Section 8, in the township of
Pokeno, being a distance of 1 mile 38 chains, more or less ;
as the same is more particularly delineated on plan
P.W.D. 102469, deposited in the office of the Main Highways
Board at Wellington, and thereon coloured green.
Also all that portion of main highway in the Franklin
County, commencing approximately 6 chains south of the
northern corner of Lot 216, Mangatawhiri Parish, and
proceeding thence generally in a south-westerly direction
and terminating opposite the southern corner of part Lot 190,
Mangatawhiri Parish, being a distance of 61 chains, more or
less ; as the same is more particularly delineated on plan
P.W.D. 102469, deposited in the office of the Main Highways
Board at Wellington, and thereon coloured green.
SECOND SCHEDULE.
HIGHWAY DISTRICT No. 1.
Waimate-Kaeo-Mangonui.—All that main highway in the
Bay of Islands, Whangaroa, and Mangonui Counties,
described in Orders in Council dated 2nd April, 1928, and 16th
December, 1935, and published in the Gazette on 5th April,
1928, and 19th December, 1935, respectively.
Pamapuria-Mangonui.—All that portion of main highway in the
Mangonui County, commencing at its junction with the
Waimate-Kaeo Mangonui Main Highway at Mort’s Bridge,
and proceeding thence generally in a northerly direction and
terminating in the vicinity of the Mangonui Hospital, near
the north-eastern corner of Section 148, Block V, Mangonui
Survey District, being a distance of 2 miles 55 chains, more or
less ; as the same is more particularly delineated on plan
P.W.D. 102472, deposited in the office of the Main Highways
Board at Wellington, marked A-B thereon, and coloured
black.
HIGHWAY DISTRICT No. 2.
Drury-Waiuku via Pukekohe.—All that main highway in the
Franklin County, Pukekohe Borough, and Waiuku Town
District, described in Orders in Council dated 26th September,
1927, and 23rd February, 1928, and published in the Gazette
on 29th September, 1927, and 24th February, 1928,
respectively.
Drury-Awhitu via Waiuku.—All that portion of main
highway in the Franklin County and Waiuku Town District
described in Order in Council dated 13th November, 1934,
and published in the Gazette on 15th November, 1934.
Pukekohe-Bombay.—All that portion of main highway in the
borough of Pukekohe, comprising that section of King
Street between Edinburgh Street and Soddon Street, being a
distance of 11 chains, more or less ; as the same is more
particularly delineated on plan P.W.D. 101602, deposited in
the office of the Main Highways Board at Wellington, and
thereon coloured red.
HIGHWAY DISTRICT No. 9.
Wellington-Auckland via Turanaki.—All that portion of
main highway in the Makara County, commencing at its
junction with the Porirua—Titahi Bay Main Highway,
opposite the western corner of Section A 138, and proceeding
thence generally in a northerly direction and terminating in
Aotea No. 5 Block, Block II, Belmont Survey District, being
a distance of 39 chains, more or less ; as the same is more
particularly delineated on plan P.W.D. 101811, deposited in
the office of the Main Highways Board at Wellington, and
thereon coloured yellow.
West Street Highway.—All that main highway in the
Borough of Feilding described in Order in Council dated
16th December, 1935, and published in the Gazette on 19th
December, 1935.
