National Parks Act, 1928, doth hereby declare that from and after the day of the date hereof, the reserve described in the Schedule hereto shall become vested in the Mayor, Councillors, and Citizens of the City of Wellington, in trust, for recreation purposes.

SCHEDULE.

WELLINGTON LAND DISTRICT.

ALL that area containing by admeasurement 3 roods 16·72 perches, more or less, being part Section 8, Evans Bay Registration District, situated in Block XI, Port Nicholson Survey District. As the same is more particularly delineated on the plan marked 332/54, deposited in the Wellington District Office, Department of Lands and Survey, and thereon bordered green.

Vesting the Control of a Reserve for Aerodrome Purposes in the Frankton Aerodrome Board.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 29th day of November, 1939.

Present:

THE HON. W. NASH PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers and authorities conferred upon him by section seventeen of the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby vest the control of the reserve described in the Schedule hereto, being land duly set apart as a reserve for aerodrome purposes, as from the date hereof, until the twenty-third day of November, one thousand nine hundred and forty-seven (unless previously altered or revoked under the said Act), in the Frankton Aerodrome Board, as constituted by an Order in Council dated the twenty-fourth day of November, one thousand nine hundred and thirty-seven, and published in the Gazette of the second day of December of that year.

SCHEDULE.

OTAGO LAND DISTRICT.

SECTION 4, Block XXXIII, Town of Frankton: Area, 3 acres 3 roods 1 perch, more or less.

Also all that area containing 3 acres 1 rood 13 perches, more or less, being Section 1483R, Block XIX, Section 3, Section 1484R, and part Section 4, Block XXXIV, Town of Frankton: Bounded, towards the north-west by Hospital Reserve, 376 links; towards the north-east by Section 1485R, Block XXXIV, 886 links; towards the south-east by other part of Section 4, 376 links; and towards the south-west by Cumberland Street, 886 links; be all the aforesaid linkages more or less. As the same is delineated on the plan marked L. and S. 54813F, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

Authorizing the Laying-off of a Street to be known as Finlay Avenue off Mackenzie Avenue, in the City of Christchurch, of a Width less than 66 ft., but not less than 43 ft., subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 7th day of December, 1939.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers vested in him by the Municipal Corporations Act, 1933, and the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the Christchurch City Council to permit the laying-off of the proposed street described in the Schedule hereto of a width less than sixty-six feet, but not less than forty-three feet, subject to the condition that no building or part of a building shall at any time be erected on the land as shown edged green on the plan referred to in the said Schedule and fronting the said street within a distance of thirty-eight feet from the centre-line of the said street.

SCHEDULE.

THAT proposed street, in the Canterbury Land District, City of Christchurch, containing by admeasurement 1 rood 19·7 perches, more or less, being Lot 3 and parts Lots 2 and 4, D.P. 9221, being part Section 21, Roimata Settlement (part of Rural Section 37). As the same is more particularly delineated on the plan marked P.W.D. 104285, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The Northern Side of Portion of Pah Street, in the Borough of Motueka, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

GALWAY, Governor-General.

ORDER IN COUNCIL.

At the Government House at Wellington, this 7th day of December, 1939.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Motueka Borough Council on the thirteenth day of June, one thousand nine hundred and thirty-nine, viz.:

“The Motueka Borough Council, being the local authority controlling the streets in the Borough of Motueka, hereby declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to northern half of Pah Street facing the southern boundary of Lot 36, D.P. 1599, part 160 N.R., Motueka District, Block IV, Motueka Survey District”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the northern side of the portion of Pah Street (described in the Schedule hereto) within a distance of thirty-five feet from the centre-line of the said portion of street.

SCHEDULE.

THE northern side of all that portion of street, situated in the Borough of Motueka, known as Pah Street, fronting Lot 36, D.P. 1599, being part Section 160 (N.R.), Motueka Original, Block IV, Motueka Survey District. As the same is more particularly delineated on the plan marked P.W.D. 103596, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.
