The Eastern Side of Portion of Ottawa Road, in the City of Wellington, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 22nd day of November, 1939.

Present:
THE HON. W. NASH PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Wellington City Council on the nineteenth day of April, one thousand nine hundred and thirty-nine, viz. :

"The Wellington City Council, being the local authority having control of the streets in the City of Wellington, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that part of the eastern side of Ottawa Road fronting Lot 4, D.P. 699 ";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the eastern side of the portion of Ottawa Road (described in the Schedule hereto) within a distance of thirty-five feet from the centre-line of the said portion of street.

SCHEDULE.

The eastern side of all that portion of street, situated in the Wellington Land District, City of Wellington, known as Ottawa Road, fronting part Lot 4, D.P. 699, being part Section 5, Kaiwarra District. As the same is more particularly delineated on the plan marked P.W.D. 104356, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Revoking the Declaration of a Main Highway and Declaring Public Highways to be Main Highways.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 22nd day of November, 1939.

THE HON. W. NASH PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers and authorities vested in him by section three of the Main Highways Act, 1922, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that on and after the date of publication of this Order in Council in the Gazette, the portion of main highway described in the First Schedule hereto shall cease to be a main highway, and doth further declare that the roads described in the Second Schedule hereto shall be main highways within the meaning and for the purposes of the Main Highways Act, 1922.

FIRST SCHEDULE.
HIGHWAY DISTRICT No. 1.

Waimamaku-Ohaeawai—All that portion of main highway in Hokianga County commencing at a point on the southern boundary of Wairau North 1a 1 in Block XII, Waoku Survey District, and proceeding thence generally in a westerly direction to and across the Waimamaku River and terminating at a point on the said highway approximately 4 chains west of the Waimamaku River opposite the south-eastern boundary of Section 16, Waimamaku Village, in Block IX, Waoku Survey District, being a distance of 38 chains, more or less; as the same is more particularly delineated on plan P.W.D. 105767, deposited in the office of the Main Highways Board at Wellington, and thereon coloured yellow.

SECOND SCHEDULE.
HIGHWAY DISTRICT No. 1.

Waimamaku-Ohaeawai—All that road or portion of road in Hokianga County, known as Lowes Bridge Deviation, commencing at its junction with the Waimamaku-Ohaeawai Main Highway on the southern boundary of Wairau North 1a 1 Block, Block XIII, Waoku Survey District, and proceeding thence in a westerly direction generally adjoining or passing through Wairau North 1a 1 Block and Waimamaku River-bed and terminating at its junction with the Waimamaku-Ohaeawai Main Highway approximately 4 chains west of the Waimamaku River opposite the south-eastern boundary of Section 16, Waimamaku Village Settlement, in Block IX, Waoku Survey District, being a distance of 40 chains, more or less; also a reinforced-concrete bridge on the said road crossing the Waimamaku River being 155 ft. in length; as the same are more particularly delineated on plan P.W.D. 105768, deposited in the office of the Main Highways Board at Wellington, and thereon coloured red and marked A-B-C.

HIGHWAY DISTRICT No. 2.

Coroglen-Waihi via Whangamata—All that road or portion of road in the Counties of Coromandel, Thames, and Ohinemuri, and Waihi Borough, commencing at its junction with the Tapu-Kaimarama Main Highway near Coroglen and proceeding generally in an easterly and southerly direction by way of Whenuakite, Tairua, Hikuai, and Whangamata, and terminating at its junction with the Pokeno-Waihi Main Highway in Waihi Borough, being a distance of approximately 59 miles 71 chains; as the same is more particularly delineated on plan P.W.D. 105766, deposited in the office of the Main Highways Board at Wellington, and thereon coloured blue.

HIGHWAY DISTRICT No. 12.

Ngahere-Blackball—All that road or portion of road in the Grey County commencing at the junction with the Inangahua Junction-Haast Pass Main Highway at Ngahere and proceeding generally in a north-westerly direction to the Township of Blackball, thence along Hart Street and Hilton Street in the said township, and terminating at the junction of Hilton Street and Harper Street, being a distance of 3 miles 6 chains more or less; as the same is more particularly delineated on plan P.W.D. 105272, deposited in the office of the Main Highways Board at Wellington, and thereon coloured green.

Vesting the Control of a Scenic Reserve in the Ashburton County Council.

GALWAY, Governor-General.

IN pursuance and exercise of the powers and authorities conferred upon him by section thirteen of the Scenery Preservation Act, 1908 (hereinafter referred to as “the said Act”), His Excellency the Governor-General of the Dominion of New Zealand doth hereby vest the control of the scenic reserve described in the Schedule hereto (being land reserved under the said Act) in the Ashburton County Council, subject to the conditions hereinafter contained, that is to say:—

  1. The period for which the control of the reserve is hereby vested shall be five years from the date hereof, unless the reservation is previously altered or revoked under the said Act.

  2. The said Council shall prepare a report each year ending on the thirty-first day of March, together with a statement of receipts and expenditure in connection with the said reserve. Such report and statement shall be sent to the Minister charged with the administration of the said Act as soon as possible after the close of the year.

  3. The said Council shall control the said reserve in accordance with the provisions of the said Act and of the regulations made thereunder.

SCHEDULE.

SHARPLIN FALLS SCENIC RESERVE.—CANTERBURY LAND DISTRICT.

RESERVES 3785 and 4247, Blocks VII and VIII, Alford Survey District: Area, 522 acres 3 roods 38 perches, more or less.

As witness the hand of His Excellency the Governor-General, this 21st day of November, 1939.
