GALWAY, Governor-General.ORDER IN COUNCIL.At the Government House at Wellington, this 25th day ofOctober, 1939.Present:HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.WHEREAS by Order in Council made on the ninth dayof November, one thousand nine hundred and thirty-eight, and published in the Gazette on the tenth day ofthe same month, at page 2363, there were conferred on theWaipa County Council in respect of portions of the Countyof Waipa all the powers with respect to the supply of waterfor domestic or industrial purposes exercisable by a dulyconstituted Borough Council under sections eighty-two toeighty-four, eighty-six to eighty-eight, Part XX (with theexception of sections two hundred and fifty-one, two hundredand fifty-three, and two hundred and fifty-four), and sectionthree hundred and forty-six of the Municipal CorporationsAct, 1933, and also section twenty of the Municipal Corporations Amendment Act, 1938:And whereas it is expedient that further powers be conferredon the said Waipa County Council in respect of those portionsof the County of Waipa described in the Schedule hereto:Now, therefore, in pursuance and exercise of the powersand authorities conferred on him by section one hundredand eighty-two of the Counties Act, 1920, and section eighty-five of the Municipal Corporations Act, 1933, and of all otherpowers and authorities enabling him in this behalf, HisExcellency the Governor-General, acting by and with theadvice and consent of the Executive Council, doth herebyconfer on the said Waipa County Council all the powers ofaBorough Council under the said section eighty-five of theMunicipal Corporations Act, 1933, and doth hereby accordinglyconsent to the said Waipa County Council making and levyingover those portions of the County of Waipa described in theSchedule hereto water rates and charges in respect both ofthe ordinary as well as of any extraordinary supply, accordingto the quantity of water consumed by any person receivingthe same as measured by meter, at such rates or chargesas may from time to time be fixed by any by-law of the Councilin that behalf, or as may be agreed on with any such person.
SCHEDULE.All that area in the Parish of Te Rapa, County of Waipa,bounded by a line commencing at the northern corner ofLot 1 on a plan deposited in the Land Transfer Office atAuckland as number 6867; thence in a south-westerlydirection along the north-western boundaries of Lots 1, 3, 4,5, 6, and 7 on the said deposited plan, and Lots 63, 64, 65,66, and 67 on a plan deposited in the said Land TransferOffice as number 9335 to the western corner of the last-mentioned Lot 67; thence southerly and easterly along thewestern boundary of the said Lot 67 to and across TawaRoad; thence along the south-western boundary of Lots 40and 41 on a plan deposited in the said Land Transfer Officeas number 8691 to and across Mahoe Street; thence alongthis line produced to meet the south-eastern boundary ofLot 2 on a plan deposited in the said Land Transfer Officeas number 24506; thence easterly by a right line to thesouthern corner of the land comprised in a plan depositedin the said Land Transfer Office as number 16618; thencenorth-easterly by a right line to the southern corner ofLot 21 on a plan deposited in the aforesaid Land TransferOffice as number 6867; thence south-easterly by a rightlineto the north-western corner of Lot 1 on plan number 258(black) of Allotments 28, 29, 30; thence along the westernand southern boundaries of the last-mentioned Lot 1 toandacross the Hamilton - Te Kuiti State Highway to the south-western corner of Lot 13 on a plan deposited in the saidLand Transfer Office as number 16443; thence easterlyalong the southern boundary of the last-mentioned Lot 13to its south-eastern corner; thence north-easterly along thesouth-eastern boundary of the last-mentioned Lot 13, Lot 12of the last-mentioned deposited plan, and Lots 4 and 3 ona plan deposited in the Auckland Land Transfer Officeunder number 15933 to the south-western end of Pine Avenue;thence south-easterly across the south-western end of PineAvenue and along the south-western boundary of Lot 1 ona plan deposited in the said Land Transfer Office undernumber 22658 to a point 4 chains distant from the south-eastern boundary of Pine Avenue measured at right anglesto the said Avenue;
