MASTERTON COUNTY COUNCIL.
UPPER PLAIN WATER-SUPPLY.—APPOINTMENT OF MANAGING RATEPAYERS.
The Water-supply Amendment Act, 1913.
IN pursuance and exercise of the powers vested in it by the Water-supply Act, 1908, and its amendments, and of all other Acts and powers (if any) it in that behalf enabling, the Masterton County Council hereby resolves by way of Special Order as follows:—
“1. That the Special Order passed by the said Council on the 8th day of May, 1902, and the resolution passed on the 19th day of January, 1929, appointing ratepayers to have the management of the Upper Plain Water-races, be rescinded.
“2. That the Council hereby appoints the following ratepayers who shall, on behalf of the said Council, have the management of the water-races in the Upper Plain Water-supply District No. 1 and in the Upper Plain Water-supply District No. 2, and who shall have and may exercise all of the powers of management possessed by the Council, namely:—
Beetham, Norman Trevor Beaumont Wardell.
Candy, George Frederick.
Gawith, Samuel Roy.
Harcambe, William Henry.
Perry, George Henry.”

We hereby certify that the foregoing Special Order was duly passed at a special meeting of the Masterton County Council held on the 8th day of August, 1939, and confirmed at a subsequent meeting held on the 12th day of September, 1939, such subsequent meeting being held not sooner than the twenty-eighth day, and not later than the seventieth day after such special meeting, and that public notice of the time and place fixed for such subsequent meeting and such Special Order was duly given once in each of the four (4) weeks immediately preceding the day on which the subsequent meeting was held, namely, in the Wairarapa Times-Age newspaper published in Masterton on the following dates: 17th, 24th, 31st August, 1939, and 7th September, 1939.

NORTH SHORE BOROUGHS (AUCKLAND) WATER BOARD.
BY-LAW NUMBER 2.
By-law of the North Shore Boroughs (Auckland) Water Board made in pursuance of the powers and provisions contained in the North Shore Boroughs (Auckland) Water-supply Act, 1924, and the Proclamation of His Excellency the Governor-General issued on the 18th day of July, 1939, and published in the Gazette under date the 27th day of July, 1939, and in pursuance of every other power and authority enabling the said Board in that behalf.
THE North Shore Boroughs (Auckland) Water Board doth by Special Order hereby ordain as follows:—
(1) The short title of this by-law shall be the “North Shore Boroughs (Auckland) Water Board By-law No. 2.”
(2) This by-law shall come into operation on the 10th day of October, 1939.
(3) In this by-law if not inconsistent with the context, “the Board,” “the Lake,” and “the gathering area,” shall have the same meanings as in the said Act and in By-law No. 1 of the said Board.
Tents, &c.
(4) No person shall without having first obtained a permit in writing from the Board, and then only subject to such conditions (if any) as the Board may impose—
(a) Erect or put up any tent, marquee, caravan, or other portable or temporary structure on any part of the gathering-area of the lake; or
(b) Keep, occupy, or use any such tent, marquee, caravan, or other structure erected or put up on any part of the gathering-area of the lake; or
(c) Being an occupier of any land in the gathering-area of the lake, permit or suffer any such tent, marquee, caravan, or other structure to be erected, put up, occupied, kept, or used on any part of the gathering-area of the lake.
Quarries, &c.
(5) No person shall on any part of the gathering-area of the lake open, make, or work any pit, stone-quarry, or rock-face, or any excavation of any kind in connection with the working of a pit, stone-quarry, or rock-face, without having first obtained a permit in writing from the Board, and then only subject to such conditions (if any) as the Board may impose.
Boats and Boating.
(6) No person shall place, moor, keep, or use any punt, raft, boat, or other craft upon the lake or upon the shore thereof, without having first obtained a permit in writing from the Board.
Penalties.
(7) (a) Every person guilty of a breach of any of the provisions of this by-law shall be liable to a penalty not exceeding five pounds (£5), or, where the breach is a continuing one then for a penalty not exceeding two pounds (£2), for every day or part of a day during which such breach continues.
(b) The continued existence in a state contrary to any of the provisions of this by-law of any work or thing shall be deemed a continuing offence within the meaning of this clause.
(c) Provided that the provisions of this by-law shall be in addition to, and shall not abridge or affect any remedy or proceeding under any other Act, or under regulations made under any other Act but so that no person shall be punished for the same offence both under this by-law and under any other law or enactment or regulations.
The foregoing By-law No. 2 was duly made by the North Shore Boroughs (Auckland) Water Board by Special Order passed and adopted at a special meeting of the said Board convened for that purpose on the 25th day of August, 1939, confirmed by the said Board on the 22nd day of September, 1939.
The common seal of the body corporate the North Shore Boroughs (Auckland) Water Board was duly affixed to the foregoing by-law this 22nd day of September, 1939, in the presence of—
