Licensing Archibald Glyn Fell to occupy a Portion of the
Land between High and Low Water Marks of the Hokianga
Harbour, and to Reclaim such Land.

At the Government House at Wellington, this 20th day of
September, 1939.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by Order in Council dated the fourteenth day
of November, one thousand nine hundred and twenty-
one, and published in the Gazette of the seventeenth day of
the same month, at page 2783, Archibald Glyn Fell (herein-
after called “ the licensee ”) was licensed to occupy a portion of
the foreshore between high and low water marks of the
Hokianga Harbour, and to reclaim such land :

And whereas the licensee has applied to have the herein-
before-recited Order in Council revoked, and it is desirable
to revoke the same :

Now, therefore, His Excellency the Governor-General of
the Dominion of New Zealand, in pursuance and exercise of
the power and authority conferred upon him by the Harbours
Act, 1923, and of all other powers and authorities enabling
him in that behalf, and acting by and with the advice and
consent of the Executive Council of the said Dominion, doth
hereby revoke the hereinbefore-recited Order in Council of
the fourteenth day of November, one thousand nine hundred
and twenty-one, as from the thirty-first day of August, one
thousand nine hundred and thirty-nine.

Authorizing the Laying-off of a Street between Morris Street
and Roberts Street in the Borough of Tauranga, of a Width
less than 66 ft. subject to Conditions as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 27th day of
September, 1939.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers vested in him by
the Municipal Corporations Act, 1933, the Public Works
Act, 1928, and of all other powers in anywise enabling him
in this behalf, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice
and consent of the Executive Council of the said Dominion,
doth hereby authorize the Tauranga Borough Council
to permit the laying-off of the portions of the proposed street
firstly and secondly described in the Schedule hereto at a
width less than sixty-six feet but not less than fifty feet and
forty-five feet, respectively, subject to the condition that no
building or part of a building shall at any time be erected on
the land fronting the said portions of street within a distance
of thirty-three feet from the centre-line or the centre-line
produced of the portion of the street firstly described in the
said Schedule.

SCHEDULE.

First, that portion of a proposed street in the Auckland
Land District, Borough of Tauranga, containing by ad-
measurement 1 rod 33·3 perches, more or less, being part
Allotment 547 (D.P. 23751); part Lot 4, D.P. 27256, of
Allotments 548 and 549; and parts Lots 1 and 12, D.P.
25421, of Allotments 551, 552, and 553; all being parts
Section 2, Town of Tauranga.

Secondly, that other portion of the said street, containing
by admeasurement 22·5 perches, more or less, being part
Allotment 546, D.P. 23751; and part Lot 1, D.P. 25421,
of Allotment 550; all being parts Section 2, Town of Tauranga.

As the same are delineated on the plan marked P.W.D.
103453, deposited in the office of the Minister of Public Works
at Wellington, and thereon coloured red and blue respectively.

The Eastern Side of Portion of Mill Road in the Borough of
New Plymouth, exempted from the Provisions of Section 128
of the Public Works Act, 1928, subject to a Condition as to
the Building-line.

GALWAY, Governor-General.

ORDER IN COUNCIL.

At the Government House at Wellington, this 27th day of
September, 1939.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the
Public Works Act, 1928, and of all other powers in
anywise enabling him in this behalf, His Excellency the
Governor-General of the Dominion of New Zealand, acting
by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby approve of the following
resolution passed by the New Plymouth Borough Council on
the third day of October, one thousand nine hundred and
thirty-eight, viz. :

“ That the New Plymouth Borough Council, being the
local authority having control of the street hereinafter
mentioned, hereby resolves and declares that the pro-
visions of section one hundred and twenty-eight of the
Public Works Act, 1928, shall not apply to that portion
of the eastern side of Mill Road to which Subdivision 2,
D.P. 1292, Town Belt W (E.R.), New Plymouth, has
frontage ”;

subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the eastern
side of the portion of Mill Road (described in the Schedule
hereto) within a distance of thirty-three feet from the centre-
line of the said portion of street.

SCHEDULE.

The eastern side of all that portion of street in the Taranaki
Land District, Borough of New Plymouth, known as Mill
Road, fronting Lot 2 on D.P. 1292, being part Section W,
New Plymouth Town Belt. As the same is more particularly
delineated on the plan marked P.W.D. 104017, deposited in
the office of the Minister of Public Works at Wellington,
and thereon coloured red.
