conferred on him by section eleven of the Local Government
Loans Board Act, 1926, as set out in section twenty-nine of
the Finance Act, 1932 (No. 2), and of all other powers and
authorities enabling him in this behalf, doth hereby vary
certain of the determinations aforesaid in respect of the said
sum by prescribing as follows :—
(1) In lieu of the term of fifteen (15) years specified in
clause one of the said Order in Council the term shall be ten
(10) years.
(2) In lieu of making provision for the repayment of the
said sum by establishing a sinking fund in respect thereof in
accordance with clause three of the said Order in Council
the said local authority shall repay the said sum as follows :-
(a) By twenty equal payments of four hundred and thirty-
one pounds six shillings (£431 6s.), one of such
payments to be made at the end of every half-year
commencing from the date on which the said sum is
borrowed. Each such half-yearly payment shall be
applied firstly in payment of interest computed at
the rate of three pounds ten shillings (£3 10s.) per
centum per annum on the amount of the principal
for the time being outstanding at the beginning of
each half-year, and the balance of such half-yearly
payment in reduction of principal.
(b) By a payment at the end of the tenth year from the
date of the borrowing of the said sum of a sum equal
to the amount to which the said principal has been
reduced in accordance with the preceding paragraph
(a) hereof after payment of the aforesaid twenty
(20) half-yearly payments.

Conferring on Waipa County Council certain Powers of Borough
Councils with respect to Waterworks.

ORDER IN COUNCIL.
At the Government House at Wellington, this 9th day of
November, 1938.
Present:
His Excellency The Governor-General in Council.
IN pursuance and exercise of the power and authority
vested in him in that behalf by section one hundred and
eighty-two of the Counties Act, 1920, His Excellency the
Governor-General, acting by and with the advice and consent
of the Executive Council, doth hereby confer on the Waipa
County Council all the powers with respect to the supply
of water for domestic or industrial purposes exercisable by a
duly constituted Borough Council under sections eighty-two
to eighty-four, eighty-six to eighty-eight, Part XX (with the
exception of sections two hundred and fifty-one, two hundred
and fifty-three, and two hundred and fifty-four), and section
three hundred and forty-six of the Municipal Corporations
Act, 1933, and also section twenty of the Municipal
Corporations Amendment Act, 1938, but subject to the
restriction that such powers shall be exercisable only
over those portions of the County of Waipa described in
the Schedule hereto.
SCHEDULE.
ALL that area in the Parish of Te Rapa, County of Waipa,
bounded by a line commencing at the northern corner of Lot 1
on a plan deposited in the Land Transfer Office at Auckland
as number 6867; thence in a south-westerly direction along
the north-western boundaries of Lots 1, 3, 4, 5, 6, and 7 on
the said deposited plan, and Lots 63, 64, 65, 66, and 67 on a
plan deposited in the said Land Transfer Office as number
9335 to the western corner of the last-mentioned Lot 67;
thence southerly and easterly along the western boundary
of the said Lot 67 to and across Tawa Road; thence along
the south-western boundary of Lots 40 and 41 on a plan
deposited in the said Land Transfer Office as number 8691
to and across Mahoe Street; thence along this line produced
to meet the south-eastern boundary of Lot 2 on a plan
deposited in the said Land Transfer Office as number 24506;
thence easterly by a right line to the southern corner of the
land comprised in a plan deposited in the said Land Transfer
Office as number 16618; thence north-easterly by a right
line to the southern corner of Lot 21 on a plan deposited in
the aforesaid Land Transfer Office as number 6867; thence
south-easterly by a right line to the north-western corner
of Lot 1 on plan number 258 (black) of Allotments 28, 29,
and 30; thence along the western and southern boundaries of
the last-mentioned Lot 1, to and across the Hamilton-Te
Kuiti State Highway, to the south-western corner of Lot
13 on a plan deposited in the said Land Transfer Office as
number 16443; thence easterly along the southern boundary
of the last-mentioned Lot 13 to its south-eastern corner;
thence north-easterly along the south-eastern boundary of
the last-mentioned Lot 13, Lot 12 of the last-mentioned
deposited plan, and Lots 4 and 3 on a plan deposited in the
Auckland Land Transfer Office under number 15933 to the

south-western end of Pine Avenue ; thence south-easterly
across the south-western end of Pine Avenue and along
the south-western boundary of Lot 1 on a plan deposited in
the said Land Transfer Office under number 22658 to a point
four chains distant from the south-eastern boundary of Pine
Avenue measured at right angles to the said avenue; thence
north-easterly by a right line parallel to Pine Avenue and
Peacocke Road to the south-western boundary of all land
comprised in a plan deposited in the said Land Transfer
Office under number 26475; thence along the south-western,
south-eastern, and north-eastern boundaries of the land
comprised in the last-mentioned deposited plan to a point
four chains distant from Peacocke Road measured at right
angles to the said road; thence north-easterly by a right
line to a point in Peacocke Road 5¼ chains distant from an
angle in Peacocke Road, measured from the said angle in an
easterly direction along the southern boundary of Peacocke
Road; thence across Peacocke Road and in a northerly
direction by a right line to a point 4 chains distant from the
northern boundary of the said road measured at right angles
to the said northern boundary; thence westerly, south-
westerly, and north-westerly by right lines parallel to and
4 chains distant from Peacocke Road to a point 4 chains
distant from the south-eastern corner of Lot 18 on a plan
deposited at the Land Transfer Office aforesaid under number
13590 measured at right angles to the said road in a north-
easterly direction; thence north-westerly by a right line
to the north-eastern corner of Lot 1 on the last-mentioned
deposited plan; thence along the northern and western
boundaries of the said Lot 1 to the north-western corner of
Lot 2 of the said deposited plan; thence by a right line
across Hospital Hill Road and the Hamilton-Te Kuiti State
Highway to the point of commencement.
All that land in the Parish of Pukete, in the County of
Waipa, bounded by a line commencing at the south-eastern
corner of Lot 3 on a plan deposited in the Land Transfer Office
at Auckland under number 19495; thence south-westerly to
and across Norton Road, along the north-western boundary
of Forest Lake Road, to the south-eastern corner of Lot 3
on a plan deposited in the said Land Transfer Office under
number 16184; thence across Forest Lake Road to the
northern corner of Lot 7 on a plan deposited in the said Land
Transfer Office under number 4458; thence south-easterly
along the northern boundary of the said Lot 7 to the Waite-
whiriwhiri Stream; thence in a southerly and westerly
direction along the northern bank of the said stream to the
southern corner of Lot 1 on a plan deposited in the Land
Transfer Office under number 12962; thence along the south-
western boundary of the said Lot 1 to Forest Lake Road:
thence easterly along the said road to the westernmost corner
of part Lot 3 of the last-mentioned deposited plan; thence
by a line across the last-mentioned road to the southern

to the western boundary of the North Island Main Trunk
Railway Reserve; thence south-easterly along the said
railway reserve to the point of commencement.
