Portion of Poole Street, in the Borough of Motueka, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

At the Government House at Wellington, this 2nd day of February, 1938.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Motueka Borough Council on the first day of December, one thousand nine hundred and thirty-seven, viz. :

“That the Motueka Borough Council, being the local authority having control of the streets in the Borough of Motueka, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of street known as Poole Street abutting on Lot 40, D.P. 1599, being part Section 160, N.R. Motueka Original District, Block IV, Motueka Survey District ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the northern side of the portion of Poole Street (described in the Schedule hereto) within a distance of thirty-five feet from the centre-line of the said portion of street.

SCHEDULE.

THE northern side of all that portion of street, situated in the Nelson Land District, Borough of Motueka, known as Poole Street, fronting Lot 40, D.P. 1599, being part Section 160 (N.R.), Motueka Original, Block IV, Motueka Survey District. As the same is more particularly delineated on the plan marked P.W.D. 98068, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Portion of Richardson Street, in the City of Nelson, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Nelson City Council on the nineteenth day of November, one thousand nine hundred and thirty-six, viz. :

“The Nelson City Council, being the local authority having control of the streets of the City of Nelson, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the south-eastern side of Richardson Street passing through Sections 10 and part 11, City of Nelson, marked A–B and coloured red on plan ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Richardson Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE south-eastern side of all that portion of street, situated in the Nelson Land District, District of Nelson, known as Richardson Street, fronting parts Sections 10 and 11, City of Nelson. As the same is more particularly delineated on the plan marked P.W.D. 94414, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Portion of Green’s Way, in the City of Christchurch, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

At the Government House at Wellington, this 2nd day of February, 1938.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Christchurch City Council on the first day of November, one thousand nine hundred and thirty-seven, viz. :

“The Christchurch City Council, being the local authority having control of the streets in the City of Christchurch, hereby by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of the street known as Green’s Way adjoining the land in Town Sections 1002, 1000, and 998 ”;

subject to the condition that no shop or other building with a public entrance to Green’s Way, and no show-windows fronting Green’s Way displaying wares for sale, shall at any time be erected or permitted to be used on the land fronting the southern side of the portion of Green’s Way (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE southern side of all that portion of street, situated in the Canterbury Land District, City of Christchurch, known as Green’s Way, fronting Town Sections 1002, 1000, and 998. As the same is more particularly delineated on the plan marked P.W.D. 98147, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured yellow.
