Portion of Walter’s Road, in the Waimairi County, exempted from the Provisions of Section 128 of the Public Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 7th day of September, 1938.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Waimairi County Council on the twenty-fifth day of May, one thousand nine hundred and thirty-eight, viz.:

“ That the Waimairi County Council, being the local authority having control of such road, hereby resolves that the road widening provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that part of the road known as Walter’s Road, Marshland, being the frontage of part Lots 41 and 42 of Deposited Plan 875, R.S. 6386, Christchurch Survey District ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side of portion of Walter’s Road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of road.

SCHEDULE.

THE western side of all that portion of road, situated in the Canterbury Land District, County of Waimairi, known as Walter’s Road, fronting part Lot 42, D.P. 875, being part R.S. 6386, Block VI, Christchurch Survey District. As the same is more particularly delineated on the plan marked P.W.D. 99937, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Portions of Carson, Kevin, and Cross Streets, in the City of Dunedin, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 7th day of September, 1938.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the eighteenth day of July, one thousand nine hundred and thirty-eight, viz.:

“ That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the undermentioned portions of streets, viz.:

“ (a) The southern side of portion of Carson Street abutting on Lot 213, Glen Estate;

“ (b) The north-eastern side of portion of Kevin Street abutting on Lot 213, Glen Estate; and

“ (c) The north-western side of portion of Cross Street abutting on Lot 213, Glen Estate ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side of the portion of Carson Street or the north-eastern side of the portion of Kevin Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of streets, or on the land fronting the north-western side of Cross Street (described in the Schedule hereto) within a distance of twenty feet from the centre-line of the said portion of street.

SCHEDULE.

THE southern side of all that portion of street, situated in the Otago Land District, City of Dunedin, known as Carson Street, fronting Lot 213, Glen Estate.

Also the north-eastern side of all that portion of street in the said land district and city known as Kevin Street, fronting Lot 213, Glen Estate.

Also the north-western side of all that portion of street in the said land district and city known as Cross Street, fronting Lot 213, Glen Estate.

As the same are more particularly delineated on the plan marked P.W.D. 100107, deposited in the office of the Minister of Public Works, and thereon edged red.

Portions of Days Road and Oxford Street, in the Borough of Lyttelton, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

At the Government House at Wellington, this 7th day of September, 1938.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Lyttelton Borough Council on the eleventh day of July, one thousand nine hundred and thirty-eight, viz.:

“ The Lyttelton Borough Council, being the local authority having control of the streets in the Borough of Lyttelton, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to those portions of streets known as Oxford Street and Days Road adjoining that portion of land contained in C.T. 417/103 ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the northern side of portion of Days Road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE northern side of all that portion of street in the Canterbury Land District, Borough of Lyttelton, known as Days Road, fronting Lot 3, D.P. 9106, being part Rural Section 1.

Also the eastern and southern sides of all those portions of street in the said land district and borough known as Oxford Street, fronting Lot 3, D.P. 9106, being part Rural Section 1.

As the same are more particularly delineated on the plan marked P.W.D. 100141, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.
