  • Cancelling a Condition as to Setting-back the Building-line on Portion of Sydney Street, in the City of Wellington, imposed by an Order in Council under Section 117 of the Public Works Act, 1908.

ORDER IN COUNCIL.

At the Government House at Wellington, this 7th day of September, 1938.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby amend the Order in Council dated the sixth day of August, one thousand nine hundred and twenty-one, and published in the New Zealand Gazette No. 77 of the eighteenth day of the same month, at page 2147, and deposited in the Land Registry Office at Wellington as No. 913, exempting the southern side of portion of Sydney Street, in the City of Wellington, from the provisions of section one hundred and seventeen of the Public Works Act, 1908, subject to a condition as to the building-line, by cancelling the condition as to the building-line imposed by the said Order in Council.

  • The Eastern Side of Portion of Murphy Street, in the City of Wellington, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 7th day of September, 1938.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Wellington City Council on the ninth day of May, one thousand nine hundred and thirty-eight, viz.:

“ The Wellington City Council, being the local authority having control of the streets in the City of Wellington, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that part of the eastern side of Murphy Street fronting part Sections 591 and 592, Town of Wellington, comprised in Certificate of Title, Volume 403, folio 10 ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the eastern side of portion of Murphy Street (described in the Schedule hereto) within a distance of thirty-five feet from the centre-line of the said portion of street.

SCHEDULE.

THE eastern side of all that portion of street, situated in the Wellington Land District, City of Wellington, known as Murphy Street, fronting part Sections 591 and 592, Town of Wellington. As the said portion of street is more particularly delineated on the plan marked P.W.D. 99995, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

  • Portions of Roads, in the County of Waimea, exempted from the Provisions of Section 128 of the Public Works Act, 1928 subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 7th day of September, 1938.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Waimea County Council on the eighth day of July, one thousand nine hundred and thirty-eight, viz.:

“ That the Waimea County Council, being the local authority having control of the roads within the Waimea County, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the following roads, namely:

“ A. The south-western side of the road fronting the north-eastern boundary of part Section 130, Block VI, Waimea Survey District, marked A–B, C–D on plan dated May, 1938, prepared by F. I. Ledger, Registered Surveyor, and coloured red thereon. (F. Busch);

“ B. The north-western side of the road fronting the south-eastern boundary of part Section 160, Waimea East, Block VI, Waimea Survey District, marked A–B on plan dated April, 1938, prepared by F. I. Ledger, Registered Surveyor, and coloured red thereon. (G. Haycock);

“ C. The south-eastern side of the road fronting the north-western boundary of Section 155 and part Section 159, Block VI, Waimea Survey District, marked A–B on plan dated July, 1938, prepared by F. I. Ledger, Registered Surveyor, and coloured red thereon. (E. J. Bartlett) ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the said portions of roads (described in the Schedule hereto), within a distance of thirty-three feet from the centre-lines of the said portions of roads.

SCHEDULE.

THE south-western side of all that portion of road in the Nelson Land District, County of Waimea, fronting part Section 130, Waimea East, Block VI, Waimea Survey District; shown A–B, C–D on plan marked P.W.D. 99996.

Also the north-western side of all that portion of road in the said land district and county known as McShane’s Road, fronting part Section 160, Waimea East, Block VI, Waimea Survey District; shown A–B on plan marked P.W.D. 99997.

Also the south-eastern side of all that portion of road in the said land district and county fronting Section 155 and part Section 159, Waimea East, Block VI, Waimea Survey District; shown A–B on plan marked P.W.D. 99998.

As the same are more particularly delineated on the plans marked as above mentioned, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.
