Varying the Determinations in respect of the Great Barrier Island County Council's Loan of £500.

GALWAY, Governor-General.

ORDER IN COUNCIL.

At the Government House at Wellington, this 20th day of July, 1938.

Present:

His Excellency the Governor-General in Council.

WHEREAS by Order in Council made on the twenty-second day of October, one thousand nine hundred and thirty-six, and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising by the Great Barrier Island County Council (hereinafter called “the said local authority”) of the sum of five hundred pounds (£500) by a loan to be known as “Blind Bay Harbour Wharf Loan, 1936” (hereinafter called “the said loan”);

And whereas the authority conferred by the said Order in Council has not yet been exercised, and it is expedient to vary certain of the determinations aforesaid in respect of the said loan:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary certain of the determinations aforesaid in respect of the said loan by prescribing as follows:—

(1) In lieu of the term of twenty-five (25) years specified in clause one of the said Order in Council the term shall be ten (10) years.

(2) In lieu of repayment as specified in clause three of the said Order in Council the said loan shall be repaid as follows:—

(a) By twenty equal payments of seventeen pounds nine shillings and ninepence (£17 9s. 9d.), one of such payments to be made at the end of every half-year commencing from the date on which the said loan is raised. Each such half-yearly payment shall be applied firstly in payment of interest computed at the rate of three pounds ten shillings (£3 10s.) per centum per annum on the amount of the principal for the time being outstanding at the beginning of each such half-year, and the balance of such half-yearly payment in reduction of such principal.

(b) By a payment at the end of the tenth year from the date of the raising of the said loan of a sum equal to the amount to which the principal has been reduced in accordance with the preceding paragraph (a) hereof after payment of the aforesaid twenty (20) half-yearly payments.

Portion of Sussex Street, in the City of Wellington, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

GALWAY, Governor-General.

ORDER IN COUNCIL.

At the Government House at Wellington, this 27th day of July, 1938.

Present:

His Excellency the Governor-General in Council.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Wellington City Council on the sixteenth day of March, one thousand nine hundred and thirty-eight, viz.:—

“The Wellington City Council, being the local authority having control of the streets in the City of Wellington, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that part of the western side of Sussex Street fronting the land comprised in plan A/2436”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side of portion of Sussex Street (described in the Schedule hereto) within a distance of thirty-five feet from the centre-line of the said portion of street,

SCHEDULE.

The western side of all that portion of street, situated in the Wellington Land District, City of Wellington, known as Sussex Street, fronting part Section 665, Town of Wellington. As the same is more particularly delineated on the plan marked P.W.D. 99742, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Portion of Beverley Street, in the City of Christchurch, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 27th day of July, 1938.

Present:

His Excellency the Governor-General in Council.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Christchurch City Council on the thirteenth day of June, one thousand nine hundred and thirty-eight, viz.:—

“The Christchurch City Council, being the local authority having control of the streets in the City of Christchurch, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of street known as Beverley Street adjoining the land contained in Certificate of Title, Volume 336, folio 93”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-western side of portion of Beverley Street (described in the Schedule hereto) within a distance of thirty-five feet from the centre-line of the said portion of street.

SCHEDULE.

The north-western side of all that portion of street, situated in the Canterbury Land District, City of Christchurch, known as Beverley Street, fronting part Rural Section 148. As the same is more particularly delineated on the plan marked P.W.D. 99942, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Portion of Dall Street, in the Borough of Green Island, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 27th day of July, 1938.

Present:

His Excellency the Governor-General in Council.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Green Island Borough Council on the fifth day of April, one thousand nine hundred and thirty-eight, viz.:—

“That the Green Island Borough Council, being the local authority having control of the streets in the Borough of Green Island, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of street known as Dall Street adjoining Allotment 38, Block C, Township of Kingston”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-western side of portion of Dall Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.
