Vesting a Reserve in the Opunake Borough Council.

GALWAY, Governor-General.

ORDER IN COUNCIL.

At the Government House at Wellington, this 20th day of January, 1938.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS the land described in the Schedule hereto has been duly set apart as a reserve for cemetery purposes: And whereas, in the opinion of the Governor-General, it is expedient to vest the said reserve in the Mayor, Councillors, and Burgesses of the Borough of Opunake:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section nine of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby declare that from and after the day of the date hereof, the reserve described in the Schedule hereto shall become vested in the Mayor, Councillors, and Burgesses of the Borough of Opunake, in trust, for cemetery purposes.

Vesting Control of a Reserve under the Tourist and Health Resorts Control Act, 1908.

GALWAY, Governor-General.

ORDER IN COUNCIL.

At the Government House at Wellington, this 20th day of January, 1938.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the power and authority conferred on him by section five of the Tourist and Health Resorts Control Act, 1908 (hereinafter termed “the said Act”), His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby vest the control of the public-utility reserve, described in the Schedule hereto, in the Minister of the Crown for the time being having the administration of the said Act; and doth hereby declare that the said reserve shall be administered under the said Act.

SCHEDULE.

AUCKLAND LAND DISTRICT.

ALL that area containing by admeasurement 1 rood, more or less, being Section 7, Block L, Town of Rotorua, comprised in Certificate of Title, Volume 658, folio 300 (Auckland Registry). As the same is more particularly delineated on the plan marked L. and S. 22/4067/1B, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged green. (Auckland plans S.O. 3879 and 28904.)

Vesting Reserves in the Waihi Borough Council.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS the lands described in the Schedule hereto have been duly set apart as reserves for municipal purposes: And whereas, in the opinion of the Governor-General, it is expedient to vest the said reserves in the Mayor, Councillors, and Burgesses of the Borough of Waihi:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section nine of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby declare that from and after the day of the date hereof, the reserves described in the Schedule hereto shall become vested in the Mayor, Councillors, and Burgesses of the Borough of Waihi, in trust, as reserves for municipal purposes.

Withdrawing Land from the Operation of the Kauri-gum Industry Act, 1908.

GALWAY, Governor-General.

ORDER IN COUNCIL.

At the Government House at Wellington, this 20th day of January, 1938.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by section one hundred and sixty-two of the Land Act, 1924, it is enacted that the Governor-General may, by Order in Council, on the recommendation of the Land Board, declare that any land comprised in a kauri-gum reserve shall, from a date to be specified in the Order, cease to be subject to the Kauri-gum Industry Act, 1908, and on and after the date so specified the land to which the Order relates shall become subject to the provisions of the Land Act, 1924:

And whereas the Land Board of the North Auckland Land District has duly passed resolutions recommending that the portion of the Rotoroa Kauri-gum Reserve Extension, as described in the Schedule hereto, be excepted from the operations of the Kauri-Gum Industry Act, 1908, and it is expedient to give effect to such recommendation:

Now, therefore, I, George Vere Arundell, Viscount Galway, Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon me by section one hundred and sixty-two of the Land Act, 1924, and acting by and with the advice and consent of the Executive Council of the said Dominion, do hereby order and declare that the portion of the Rotoroa Kauri-gum Reserve Extension as described in the Schedule hereto shall, from the first day of February, one thousand nine hundred and thirty-eight, cease to be subject to the Kauri-gum Industry Act, 1908.

SCHEDULE.

NORTH AUCKLAND LAND DISTRICT.

ALL that area in the Mangonui County containing by admeasurement 105 acres 2 roods 13 perches, more or less, being portion of Rotoroa Kauri-gum Reserve Extension, now known as Section 36, Block VII, Opoe Survey District. As the same is more particularly delineated on the plan marked L. and S. 22/1747A, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red. (North Auckland plan 27441.)
