Portions of York Street and the Strand, in the Town District
of Russell, exempted from the Provisions of Section 128 of
the Public Works Act, 1928, subject to a Condition as to the
Building-line.

GALWAY, Governor-General.
ORDER IN COUNCIL.
At the Government House at Wellington, this 22nd day of
June, 1938.

Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the
Public Works Act, 1928, and of all other powers in
anywise enabling him in this behalf, His Excellency the
Governor-General of the Dominion of New Zealand, acting
by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby approve of the following
resolution passed by the Russell Town Board on the fourteenth
day of February, one thousand nine hundred and thirty-eight,
viz.:

"The Russell Town Board, being the local authority
having control of the roads and streets in the Russell
Town District, by resolution declares that the provisions
of section one hundred and twenty-eight of the Public
Works Act, 1928, shall not apply to those portions of
streets known as York Street and the Strand adjoining

part of Lot 4 and parts of Lot 5 respectively of Section 9
of the Town of Russell comprised in Certificate of Title
(limited as to parcels), Volume 546, folio 118, Certificate of
Title 693, folio 58, and Deed of Conveyance No. 402892
(Auckland)";

subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the western
side of portion of York Street or the eastern side of portion of
the Strand (described in the Schedule hereto), within a
distance of thirty-three feet from the centre-lines of the said
portions of streets.

SCHEDULE.

The western side of all that portion of street, situated in the
North Auckland Land District, Town District of Russell,
known as York Street, fronting part Lot 4 of Section 9, Town
of Russell, Block 1, Russell Survey District.

Also the eastern side of all that portion of street in the said
land district and town district, known as the Strand, fronting
parts Lot 5 of Section 9, Town of Russell, Block 1, Russell
Survey District.

As the same are more particularly delineated on the plan
marked P.W.D. 99259, deposited in the office of the Minister
of Public Works at Wellington, and thereon edged red.

Consenting to stopping Road in Blocks X and XIII, Whaingaroa Survey District, Raglan County.

ORDER IN COUNCIL.
At the Government House at Wellington, this 29th day of June, 1938.

Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers and authorities conferred by the Public Works Act, 1928, and of all other powers
in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by
and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the Raglan County
Council stopping the portions of road described in the Schedule hereto.

IN pursuance and exercise of the powers and authorities conferred by the Public Works Act, 1928, and section thirty-two
of the Statutes Amendment Act, 1936, His Excellency the Governor-General of the Dominion of New Zealand, acting
by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the land described
in the Schedule hereto being taken for housing purposes.
