SOUTHLAND LAND, REGISTRATION, AND LAND REGISTRATION DISTRICTS.
ALL that area in the Dominion of New Zealand, bounded towards the north-east generally by the Otago Land, Registration, and Land Registration Districts hereinbefore described from Stripe Point to the sea at the south-eastern corner of Waikawa Survey District; then towards the south and west generally by the sea to the place of commencement; with all islands adjacent thereto and including Stewart, Solander, Ruapuke, the Snares, Auckland, Enderby, Campbell, Antipodes, and Bounty Islands, and all other islands or islets within the limits of the Dominion which lie south of the forty-seventh parallel of south latitude.

Authorizing Hugh John McGaw, of Purekireki, Farmer, to use Water for the Purpose of generating Electricity and to erect certain Electric Lines
GALWAY, Governor-General.
ORDER IN COUNCIL.
At the Government House at Wellington, this 7th day of June, 1938.

His Excellency the Governor-General in Council.
PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council, doth hereby grant to Hugh John McGaw, of Purekireki, Farmer (hereinafter referred to as “the licensee”), a license subject to the conditions hereinafter set forth to obstruct, impound, or divert the waters of the Owaka River at a point opposite the northern boundary of Section 8, Block 8, Wairepa Survey District in the Land District of Otago, and to take and use therefrom for the purposes hereinafter set forth a stream of water not exceeding three cubic feet per second at any one time, and to lay, construct, put up, place, and use the electric lines hereinafter described.
CONDITIONS.
- IMPLIED CONDITIONS.
THE conditions directed to be implied in all licenses by the Water-power Regulations, 1934, and the Electrical Supply Regulations, 1935, shall be incorporated in and shall form part of this license, except in so far as the same may be inconsistent with the provisions hereof.
- LICENSE SUBJECT TO REGULATIONS.
This license is issued under the Water-power Regulations, 1934, and is subject thereto and to the Electrical Supply Regulations, 1935, and the Electrical Wiring Regulations, 1935, and to any regulations made in amplification or amendment thereof or in substitution therefor.
- UTILIZATION OF WATER AND LOCATION OF HEADWORKS.
Water shall be used under this license solely for the purpose of generating electricity, and shall be taken from the stream at the point opposite the northern boundary of Section 8, Block 8, Wairepa Survey District, indicated on the plan marked P.W.D. 98408, deposited in the office of the Minister of Public Works.
- GENERAL DESCRIPTION OF WORKS.
The licensee is hereby authorized, subject to the conditions hereof, to construct, maintain, and use the following works for the purposes of this license, the positions of the said works being indicated on the said plan P.W.D. 98408:—
(a) Headworks consisting of a dam, intake, and pipelines leading to the water-wheel and power-house hereinafter referred to, giving a static head of approximately 37 feet.
(b) Tail-race leading from the said water-wheel to the said stream.
(c) A power-house situated on the licensee’s premises in Section 8, Block 8, Wairepa Survey District, with all necessary generating and switching equipment.
(d) Electric lines leading from the power-house aforesaid across the Clinton–Owaka Road to the licensee’s dwelling situated in the said Section 8, Block 8, Wairepa Survey District, all being in the Land District of Otago.
- DURATION OF LICENSE.
Unless sooner determined, this license shall continue in force until the 31st day of March, 1958, or until a supply of electrical energy is available from an Electric-power Board, or other general public source, whichever is the earlier.
- SYSTEM OF SUPPLY.
The system of supply is classified as being under paragraph (d) of clause 21–01 of the Electrical Supply Regulations, 1935. The generating and transmission voltages shall be approximately 230 volts direct current.
- RENTAL.
For the purpose of assessing the annual rental payable in respect of this license, the licensee may install a suitable maximum-demand indicator to the satisfaction of the Inspecting Engineer of the Public Works Department, and, failing such installation, the rental shall be assessed on the maximum generating capacity of the plant installed. The present plant is rated at 8 kilowatts, and falls within the class described in paragraph (c) of subclause (B) of clause (1) of Regulation 6 of the Water-power Regulations, 1934.

Licensing Edward Mizen to use and occupy a Part of the Foreshore at Mercury Island as a Site for a Cattle-race.

At the Government Buildings at Wellington, this 1st day of June, 1938.

PURSUANT to the Harbours Act, 1923, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby license and permit Edward Mizen, of Mercury Island (hereinafter called “the licensee” which term shall include his executors, administrators, and assigns unless the context requires a different construction), to use and occupy all that part of the foreshore at Mercury Island, shown on plan marked M.D. 5821, approved on the thirteenth day of May, one thousand nine hundred and twenty-four, and deposited in the office of the Marine Department at Wellington, for the purpose of the use of the cattle-race as shown on the said plan for a term of fourteen years computed from the thirteenth day of May, one thousand nine hundred and thirty-eight, such license to be held and enjoyed by the licensee upon and subject to the terms and conditions set forth in the Schedule hereto.
