Portion of Hart Street, in the City of Dunedin, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 20th day of May, 1938.

Present :

THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the fourteenth day of March, one thousand nine hundred and thirty-eight, viz. :—

“ That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the western side of portion of Hart Street abutting on Lot 5, Block IV, Township of Roslyn ” ; subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side of the portion of Hart Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE western side of all that portion of street, situated in the Otago Land District, City of Dunedin, known as Hart Street, fronting Lot 5, Block IV, Township of Roslyn. As the same is more particularly delineated on the plan marked P.W.D. 98887, deposited in the office of the Minister of Public Works at Wellington, and thereon edged red.

Portion of Humber Street, in the Borough of Oamaru, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Oamaru Borough Council on the twentieth day of January, one thousand nine hundred and thirty-eight, viz. :—

“ The Mayor, Councillors, and Burgesses of the Borough of Oamaru, being the local authority having control of the streets in the Town of Oamaru, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of Humber Street adjoining Sections 11 and 12, Block V, on the public map of the Town of Oamaru ” ; subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-western side of the portion of Humber Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE north-western side of all that portion of street, situated in the Otago Land District, Borough of Oamaru, known as Humber Street, fronting Sections 11 and 12, Block V, Town of Oamaru. As the same is more particularly delineated on the plan marked P.W.D. 98438, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured brown.

“ That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the south-western side of portion of Falcon Street abutting on Allotment 3, L.T.P. 1444, being part of Block IV, Upper Kaikorai District ” ; subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-western side of the portion of Falcon Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

Varying the Determinations in respect of Portion (£20,000) of the Waitemata Electric-power Board’s Loan of £50,000.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 20th day of May, 1938.

Present :

THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.

WHEREAS by Order in Council made on the sixteenth day of March, one thousand nine hundred and thirty-eight, and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising in New Zealand by the Waitemata Electric-power Board (hereinafter called “the said local authority”) of the sum of fifty thousand pounds (£50,000), being portion of the Reticulation Extension Loan, 1938, of £100,000 :

And whereas the authority conferred by the said Order in Council has not yet been exercised, and it is expedient to vary certain of the determinations aforesaid in respect of the sum of twenty thousand pounds (£20,000) (hereinafter called “the said sum”) :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary certain of the determinations aforesaid in respect of the said sum by prescribing as follows :—

(1) In lieu of the term of twenty-five (25) years specified in clause one of the said Order in Council the term shall be ten (10) years.
