Portion of Straven Terrace, in the Borough of Riccarton, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 11th day of May, 1938.
Present:
THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Riccarton Borough Council on the twenty-eighth day of February, one thousand nine hundred and thirty-eight, viz. :
“ The Riccarton Borough Council, being the local authority having control of the streets in the Borough of Riccarton, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of street known as Straven Terrace, adjoining land in Lot 296, D.P. 4530 ”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the northern side of the portion of Straven Terrace (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.
SCHEDULE.
THE northern side of all that portion of street, situated in the Canterbury Land District, Borough of Riccarton, known as Straven Terrace, fronting Lot 296, D.P. 4530. As the same is more particularly delineated on the plan marked P.W.D. 98844, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Portion of Ann Street, in the City of Dunedin, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-western side of the portion of Ann Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.
SCHEDULE.
THE north-western side of all that portion of street, situated in the Otago Land District, City of Dunedin, known as Ann Street, fronting part Lot 10, Deeds Plan 9, Township of Sunnyside. As the same is more particularly delineated on the plan marked P.W.D. 99060, deposited in the office of the Minister of Public Works at Wellington, and thereon edged red.

Portion of Highgate, in the City of Dunedin, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

“ That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the south-eastern side of portion of Highgate abutting on Lot 9, D.P. 262, Township of Bellevue ”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Highgate (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.
SCHEDULE.
THE south-eastern side of all that portion of street, situated in the Otago Land District, City of Dunedin, known as Highgate, fronting Lot 9, D.P. 262, Township of Bellevue. As the same is more particularly delineated on the plan marked P.W.D. 98903, deposited in the office of the Minister of Public Works at Wellington, and thereon edged red.

THE north-western side of all that portion of street, situated in the Otago Land District, City of Dunedin, known as Signal Hill Road, fronting Allotments 29, 30, 31, 32, 33, and 34, L.T.P. 72, Township of Maybank. As the same is more particularly delineated on the plan marked P.W.D. 98626, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.
