Varying the Determinations in respect of Portion (£6,000) of
the Waitaki Electric-power Board’s Loan of £30,000.

ORDER IN COUNCIL.
At the Government House at Wellington, this 9th day of
February, 1938.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS by Order in Council made on the twenty-first
day of December, one thousand nine hundred and
thirty-seven, and subject to the determinations as to borrowing
and repayment therein set out, consent was given to the
raising in New Zealand by the Waitaki Electric-power Board
(hereinafter called “the said local authority”) of the sum of
thirty-thousand pounds (£30,000) by a loan to be known as
“Extension Loan, 1937” (hereinafter called “the said loan”):
And whereas it is expedient to vary certain of the deter-
minations aforesaid in respect of the sum of six thousand
pounds (£6,000) (hereinafter called “the said sum”):
Now, therefore, His Excellency the Governor-General of
the Dominion of New Zealand, acting by and with the advice
and consent of the Executive Council of the said Dominion,
and in pursuance and exercise of the powers and authorities
conferred on him by section eleven of the Local Government
Loans Board Act, 1926, as set out in section twenty-nine of
the Finance Act, 1932 (No. 2), and of all other powers and
authorities enabling him in this behalf, doth hereby vary
certain of the determinations aforesaid in respect of the said
sum by prescribing as follows:—
(1) In lieu of the term of twenty-five (25) years specified
in clause one of the said Order in Council the term shall be
ten (10) years.
(2) In lieu of provision for repayment as specified in clause
(3) of the said Order in Council the said sum shall be repaid
as follows:—
(a) By twenty equal payments of two hundred and
nine pounds sixteen shillings and eightpence
(£209 16s. 8d.), one of such payments to be made
at the end of every half-year commencing from the
date on which the said sum is borrowed. Each such
half-yearly payment shall be applied firstly in payment
of interest computed at the rate of three pounds
ten shillings (£3 10s.) per centum per annum on the
amount of the principal for the time being outstanding
at the beginning of each such half-year, and the
balance of such half-yearly payment in reduction
of principal.
(b) By a payment at the end of the tenth year from the
date of the borrowing of the said sum of a sum equal
to the amount to which the said principal has been
reduced in accordance with the preceding paragraph
(a) hereof after payment of the aforesaid twenty (20)
half-yearly payments.

Authorizing Graham Brothers, Limited, of Waiho, to use
Water for the Purpose of generating Electricity and to erect
Electric Lines.

ORDER IN COUNCIL.
At the Government House at Wellington, this 23rd day of
February, 1938.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Public Works Act, 1928, His Excellency
the Governor-General of the Dominion of New Zealand,
acting by and with the advice and consent of the Executive
Council, doth hereby grant to Graham Brothers, Limited,
being a company duly incorporated under the Companies
Act, 1933, having its registered office at Waiho (hereinafter
referred to as “the licensee”), a license, subject to the con-
ditions hereinafter set forth, to obstruct, impound, or divert
the waters of the Atupau River situated in Block XII, Waiho
Survey District, in the Land District of Westland, and to
take and use therefrom for the purposes hereinafter set forth
a stream of water not exceeding twenty cubic feet per second
at any one time, and to lay, construct, put up, place, and use
the electric lines hereinafter described, also such further
lines as may be necessary for the supplying of electricity
within the area of supply hereinafter defined.
CONDITIONS.
- IMPLIED CONDITIONS.
The conditions directed to be implied in all licenses by the
Water-power Regulations, 1934, and the Electrical Supply
Regulations, 1935, shall be incorporated in and shall form
part of this license, except in so far as the same may be
inconsistent with the provisions hereof.
- LICENSE SUBJECT TO REGULATIONS.
This license is issued under the Water-power Regulations,
1934, and is subject thereto and to the Electrical Supply
Regulations, 1935, and the Electrical Wiring Regulations,
1935, and to any regulations made in amplification or amend-
ment thereof or in substitution therefor.
- UTILIZATION OF WATER AND LOCATION OF HEADWORKS.
Water shall be used under this license solely for the purpose
of generating electricity up to a maximum capacity of
150 kilowatts, and shall be taken from the river at the point
in Block XII, Waiho Survey District, indicated on the plan
marked P.W.D. 96643, deposited in the office of the Minister
of Public Works.
- GENERAL DESCRIPTION OF WORKS, AND AREA OF SUPPLY.
The licensee is hereby authorized, subject to the conditions
hereof, to construct, maintain, and use the following works
for the purposes of this license, the positions of the said works
being indicated on the said plan P.W.D. 96643:—
(a) Headworks consisting of dam, intake, and water-race
tunnels and pipe-line leading to the water-wheel and
power-house hereinafter referred to, giving a static
head of approximately 150·6 ft.
(b) Tail-race from the said water-wheel to the Atupau River.
(c) Power-house situated on Block XII, Waiho Survey
District, with all necessary equipment, including
water turbines, generators, transformers, lightning-
arresters, switchboards, switches, exciters, and
other appliances for generating electricity.
(d) Electric lines leading from the power-house aforesaid
across part Blocks XII, XI, VII, thence across and
along an unformed road in the Waiho Township,
thence across the Main Road to the licensee’s
premises and shown by means of a black line on
the said plan, and also such further lines as may
from time be necessary for the supplying of elec-
trical energy, within a radius of twenty chains of the
Glacier Hotel, situated in the Township of Waiho,
such area being shown bordered red on plan P.W.D.
98013, deposited in the office of the Minister of
Public Works.
- DURATION OF LICENSE.
This license shall, unless sooner determined, continue in
force until the 31st day of March, 1958.
- SYSTEM OF SUPPLY.
The system of supply shall be as described in paragraphs
(a) and (f) of clause 21–01 of the Electrical Supply Regulations,
1935. The generating voltage shall be 400 volts and trans-
mission voltage shall be approximately 11,000 volts alter-
nating current between phases.
- CHARGES ON SALE.
Maximum Charges.
(1) The licensee is authorized to make a maximum charge
as follows for electrical energy distributed under the authority
of the license:—
(a) In respect of each house or shop supplied, a sum not
exceeding 7s. 6d. per month.
(b) In respect of each shop with living quarters attached, a
sum not exceeding 10s. per month.
(c) In respect of other consumers, such sum as may be
agreed upon, or alternatively, in the event of meters
being installed, the maximum charge shall not
exceed the sum of 1s. per unit for lighting purposes,
and 6d. per unit for other purposes.
Intervals of Payments.
(2) Payment shall not be demanded from any consumer at
intervals apart of less than twenty-one days.
- RENTAL.
For the purpose of assessing the rental or annual sum
payable in respect of the license, the licensee may install a
suitable maximum-demand indicator to the satisfaction of
the Inspecting Engineer of the Public Works Department
