Consenting to the raising of a Loan of £1,297 by the Mount
Maunganui Town Board and prescribing the Conditions
thereof.

GALWAY, Governor-General.
ORDER IN COUNCIL.
At the Government House at Wellington, this 8th day of
December, 1937.
Present:

His Excellency The Governor-General in Council.
WHEREAS the Mount Maunganui Town Board (hereinafter called "the said local authority") proposes,
pursuant to the provisions of section three of the Main
Highways Amendment Act, 1928, to borrow the sum of one
thousand two hundred and ninety-seven pounds (£1,297) by
a loan to be known as "Main Highways Loan, 1937" (hereinafter called "the said loan"), for the purpose of paying
the Town Board's share of the cost of reconstructing and
sealing the Mount Maunganui Town District section of the
Papamoa-Mount Maunganui Main Highway:

Now, therefore, His Excellency the Governor-General of
the Dominion of New Zealand, acting by and with the advice
and consent of the Executive Council of the said Dominion,
and in pursuance and exercise of the powers and authorities
conferred on him by section eleven of the Local Government
Loans Board Act, 1926, as set out in section twenty-nine of
the Finance Act, 1932 (No. 2), and of all other powers and
authorities enabling him in this behalf, doth hereby consent
to the raising by the said local authority of the said loan for
the said purpose up to the amount of one thousand two
hundred and ninety-seven pounds (£1,297), and in giving
such consent doth hereby determine as follows:-

(1) The term for which the said loan or any part thereof
may be raised shall be seven (7) years.

(2) The rate of interest that may be paid in respect of
the said loan or any part thereof shall be such as shall not
produce to the lender or lenders a rate exceeding three
pounds ten shillings (£3 10s.) per centum per annum.

(3) The said loan together with interest thereon shall
be repaid by equal aggregate annual instalments extending
over the term as determined in (1) above.

(4) No moneys shall be borrowed under this consent after
the expiration of two years from the date hereof.

Varying the Determinations in respect of the Hauraki Plains
County Council's Loan of £60,000.

ORDER IN COUNCIL.
At the Government House at Wellington, this 8th day of
December, 1937.
Present:

His Excellency The Governor-General in Council.
WHEREAS by Order in Council made on the eighteenth
day of March, one thousand nine hundred and
thirty-seven, and subject to the determinations as to borrowing and repayment therein set out, consent was given to the
raising by the Hauraki Plains County Council (hereinafter
called "the said local authority") of the sum of sixty thousand
pounds (£60,000) by a loan to be known as "East Water-supply Loan, 1937" (hereinafter called "the said loan"):

And whereas the authority conferred by the said Order in
Council has not yet been exercised, and it is expedient to
vary certain of the determinations aforesaid in respect of
the said loan:

Now, therefore, His Excellency the Governor-General of
the Dominion of New Zealand, acting by and with the advice
and consent of the Executive Council of the said Dominion,
and in pursuance and exercise of the powers and authorities
conferred on him by section eleven of the Local Government
Loans Board Act, 1926, as set out in section twenty-nine of
the Finance Act, 1932 (No. 2), and of all other powers and
authorities enabling him in this behalf, doth hereby vary
certain of the determinations aforesaid in respect of the
said loan by cancelling clauses (3) and (4) of the said Order
in Council, and substituting therefor the following clauses:-

(3) The said local authority shall make provision for
the repayment of the said loan by the half-yearly redemption
of debentures of the respective amounts stated opposite
each consecutive half-year in the Schedule hereunder,
the first such redemption to be made not later than eighteen
(18) months after the first day from which interest to the
lender or lenders is computed on the said loan or any part
thereof so raised.

be made in New Zealand and no such redemptions or
interest shall be paid out of loan-moneys.

Licensing Mate Sunde to use and occupy a Part of the Foreshore and Land below Low-water Mark at Te Kopuru,
Northern Wairoa River, Kaipara Harbour, as a Site for a
Wharf and a Barge-landing.

GALWAY, Governor-General.
ORDER IN COUNCIL.
At the Government House at Wellington, this 8th day of
December, 1937.
Present:

His Excellency The Governor-General in Council.
Pursuant to the Harbours Act, 1923, His Excellency
the Governor-General, acting by and with the advice
and consent of the Executive Council, doth hereby license
and permit Mate Sunde, of Te Kopuru (hereinafter called
"the licensee," which term shall include his executors,
administrators, and assigns unless the context requires a
different construction), to use and occupy all those parts
of the foreshore and land below low-water mark at Te Kopuru,
Northern Wairoa River, Kaipara Harbour, as shown on
plan marked M.D. 7670, and deposited in the office of the
Marine Department at Wellington, for the purpose of the
use of the wharf and barge-landing as shown on the said
plan, such license to be held and enjoyed by the licensee
upon and subject to the terms and conditions set forth in
the Schedule hereto.

SCHEDULE.

  1. In these conditions the terms-
    "Foreshore" means such parts of the bed, shore, or
    banks of a tidal water as are covered and uncovered
    by the flow and ebb of the tide at ordinary spring
    tides:
    "Low-water mark" means low-water mark at ordinary
    spring tides:
    "Minister" means the Minister of Marine as defined
    by the Shipping and Seamen Act, 1908, and includes
    any officer, person, or authority acting by or under
    the direction of such Minister.

  2. The concessions and privileges conferred by this Order
    in Council shall extend and apply only to the part of the
    foreshore and land below low-water mark adjacent thereto
    necessary for the maintenance of the said wharf and barge-landing at the sites shown on the plan marked M.D. 7670.
