vary certain of the determinations aforesaid in respect of portion, £10,000, of the said loan (hereinafter called “the said sum”):
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary certain of the determinations aforesaid in respect of the said sum by prescribing that in lieu of making provision for the repayment of the said sum by establishing a sinking fund in respect thereof, the said local authority may raise the said sum upon terms of making the same, together with interest thereon, repayable by equal aggregate annual or half-yearly instalments extending over a period of twenty (20) years.

Order in Council varying the Determinations in respect of the Panmure Township Road Board’s Loan of £2,500.

ORDER IN COUNCIL.
At the Government House at Wellington, this 27th day of January, 1937.
Present:
His Excellency the Governor-General in Council.
WHEREAS by Order in Council made on the eighteenth day of November, one thousand nine hundred and thirty-six, and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising in New Zealand by the Panmure Township Road Board (hereinafter called “the said local authority”) of the sum of two thousand five hundred pounds (£2,500) by a loan to be known as “Water-supply Loan, 1936” (hereinafter called “the said loan”):
And whereas by Order in Council made on the ninth day of December, one thousand nine hundred and thirty-six, the determinations as to repayment were varied to provide for repayment together with interest by thirty equal aggregate half-yearly payments of eighty-seven pounds eight shillings and sevenpence (£87 8s. 7d.) with the repayment of the balance of principal outstanding at the end of the fifteenth year:
And whereas the authority conferred by the said Order in Council has not yet been exercised:
And whereas the said local authority now desires to borrow only two thousand three hundred pounds (£2,300) of the said loan (hereinafter called “the said sum”), and it is expedient to vary the amount of the half-yearly payments:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary the determinations in respect of the said loan by prescribing equal half-yearly payments of eighty pounds eight shillings and ninepence (£80 8s. 9d.) in lieu of payments of eighty-seven pounds eight shillings and sevenpence (£87 8s. 7d.).

The Southern Side of Portion of Leach Street, and the Northern Side of Portion of Lemon Street, in the Borough of New Plymouth, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this 3rd day of February, 1937.

His Excellency the Governor-General in Council.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the New Plymouth Borough Council on the twenty-first day of December, one thousand nine hundred and thirty-six, viz.:
“That the New Plymouth Borough Council, being the local authority having control of the streets hereinafter mentioned, hereby resolves and declares that the provisions of section one hundred and twenty-eight, subsection one, of the Public Works Act, 1928, shall not apply—
“(a) To that portion of the southern side of Leach Street to which Section 1562 and part Section 1563 have frontage: nor
“(b) To that portion of the northern side of Lemon Street to which Section 1587, New Plymouth, has frontage”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side of the portion of Leach Street, or the northern side of the portion of Lemon Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-lines of the said portions of streets.
SCHEDULE.
THE southern side of all that portion of street, situated in the Taranaki Land District, Borough of New Plymouth, known as Leach Street, fronting Section 1562, and part Section 1563, Town of New Plymouth.
Also the northern side of all that portion of street, situated in the said land district and borough, known as Lemon Street, fronting Section 1587, Town of New Plymouth.
As the same are more particularly delineated on the plan marked P.W.D. 94676, deposited in the office of the Minister of Public Works at Wellington, and thereon edged red.

Notice bringing Part of Railway Reserve within the Operation of the Mining Act, 1926.
GALWAY, Governor-General.
IN pursuance and exercise of the powers conferred on me by section twenty-five of the Mining Act, 1926, and of every other power and authority enabling me in this behalf, I, George Vere Arundell, Viscount Galway, Governor-General of the Dominion of New Zealand, do hereby declare that the part of the railway reserve described in the Schedule hereto shall be brought within the operation of the Mining Act, 1926; and do hereby further declare that this notice shall take effect as from the date of the publication hereof in the New Zealand Gazette.
SCHEDULE.
ALL that area in the Otago Land District containing by admeasurement 10 acres 0 roods 20 perches, more or less, being portion of Railway Reserve, Block IV, Glenorchy Survey District, situated 2500 links southwards of Trig. A on a line bearing 160° and being bounded as follows: Northerly by a line bearing 70°, 645·37 links; easterly by the boundary of the railway reserve bearing 161° 17', 1591·3 links; southerly by a line bearing 250°, 618·96 links; and westerly by a line bearing 340°, 1590·91 links. As the same is more particularly delineated on the plan marked N. 10/13/110, deposited in the office of the Mines Department at Wellington, and thereon coloured red.
As witness the hand of His Excellency the Governor-General, this 27th day of January, 1937.
